Accordingly we determine that the chances of SKAI GLEN were materially prejudiced and therefore declare that horse a non starter.
Facts:
Mr Williamson demonstrated the video films which clearly showed that gate 3 from which SKAI GLEN started remained closed when all the others had opened. Mr Williamson said it did not appear that SKAI GLEN had played any part in the gate being so slow and it was obviously a gate malfunction.

Mr Colgan, rider of SKAI GLEN confirmed his gate was slow to open and his mount had to push forward to get out.
Mr Humphries, the starter, said that although they had had trouble in the past with SKAI GLEN, on this occasion he was standing quietly. He said the assistant who was beside the horse brought it to his attention that the gate was slow.
Reasons for Decision:
The committee reviewed the video footage and considered the evidence. We are satisfied that the gate was slow to open which resulted in SKAI GLOW being denied a fair start. We are further satisfied this was due to mechanical failure of the starting gate and in no way attributable to the behaviour of SKAI GLEN.
