Therefore after taking all the above into account the protest is upheld and the placings shall now be:

1st  7   SAKHEE'S SOLDIER

2nd 5   KING KROVANH

3rd  1   WORTHING

4th  8   CLARA JANE

We order the payment of stakes and dividends accordingly.

Facts:

Following race 3 a protest was lodged by the informant Mr M Du Plessis, rider of KING KROVANH.  He alleged that WORTHING, placed second by the judge, interfered with the chances of his mount KING KROVANH, placed third by the judge.  He said this interference occurred in the final straight. 

The judge's placings are as follows:

7  SAKHEE'S SOLDIER    1st

1  WORTHING               2nd

5  KING KROVANH        3rd

8  CLARA JANE              4th

The margins were as follows:  2 1/4 lengths between first and second, 3/4 length between second and third and 1 1/4 lengths between third and fourth.

Submissions for Decision:

Mr Du Plessis demonstrated the video films pointing out to the hearing where he was continually being pushed wide all the way down the home straight. He said this was caused by the horse WORTHING moving out when not clear, a movement which cost him at least 3 lengths. Mr Du Plessis said he had no doubt he should have finished 2nd.

Mr Alton said Mr Du Plessis was wide anyway but conceded the 2 horses did come together at the 100 metres. However he added that WORTHING was going better and was 3/4 length clear of KING KROVANH at the post.

Mr Williamson when asked for his assessment of the protest said it was clear that early in the run home KING KROVANH was forced outwards by four horse widths and over the final 300 metres was forced out another 10 horse widths.  For these reasons he submitted the stewards supported the protest.

Reasons for Decision:

The committee carefully reviewed the video films and considered the evidence as submitted.  We find that the interference to KING KROVANH was significant in that it was forced out at least ten horse widths over the final 300 metres.  The committee also took into account the strong manner in which KING KROVANH was finishing and the margin of 3/4 length at the post. 

Accordingly we are satisfied that if interference had not occurred KING KROVANAH would have beaten WORTHING.
