R Taupo 30 December 2012 – R 7 (instigating a protest)
ID: JCA15150
Code:
Thoroughbred
Meet Title:
Taupo RC - 30 December 2012
Meet Chair:
NMcCutcheon
Meet Committee Member 1:
JHolloway
Race Date:
2012/12/30
Race Number:
R 7
Decision:
Due to the protest being upheld the placings then read:
1st - No. 6 Galshaan
2nd - No. 3 Veldt
3rd - No. 5 Runaway Bride
4th - No. 8 Viking Ace
The committee ordered that dividends and prize money be paid on the amended placings.
Facts:
Mr Bosson alleged that Runaway Bride, placed second by the Judge, interfered with the chances of Veldt (3rd), the interference occurring in the final straight.
The official margin between 2nd and 3rd was a long head.
Judges Placings were;
1st - No. 6 Galshaan
2nd - No. 5 Runaway Bride
3rd - No. 3 Veldt
4th - No. 8 Viking Ace
Submissions for Decision:
Mr Bosson stated that near the 100m Mr Jones and Runaway Bride were to his inside, that they could not get a run and that they came out and bumped Veldt out by about 3 horse widths, he said he had to stop riding and rebalance his mount and with the margin only being a long head said that it cost his mount 2nd placing. Mr Bosson then demonstrated the incident on the available video replays.
Ms House, the trainer of Runaway Bridge, said that in her opinion the interference was very minor, it often happens when horses are racing in tight quarters and in her opinion it did not affect the result of the race.
Mr Jones, the rider of Runaway Bride, said that he was in a tight gap; his horse had his feet inside Veldt and outside the eventual winner Galshaan after coming from 3 lengths behind Veldt and that Galshaan had come out half a horse width. He then came between the two horses and Mr Bosson’s horse shifted out. We both continued to ride out hands and heels and that Mr Bosson had to put his whip away. He added that he only rode hands and heels to the line and after coming from 3 lengths in arrears was able to hold Veldt off for 2nd placing and said that there was not any way in which Mr Bosson’s mount was going to beat his horse.
Mr Oatham was invited by the committee to make a submission on the alleged interference and stated that at no stage was there a full run for Mr Jones to improve, that Mr Jones forced a run for himself by making contact with Mr Bosson’s mount and shifted Mr Bosson’s mount out by about 2 horse widths. He added that the ground lost by Veldt due to the interference would have been more than the long head margin and that the stewards would support the protest.
Reasons for Decision:
After giving due consideration to all of the evidence, the committee found that racing inside the final 100m, Runaway Bride was racing behind the leading horse Galshaan and to the inside of Veldt. Shortly afterwards Mr Jones angled Runaway Bride outwards when there was insufficient room to do so and as a result Veldt received a relatively severe bump and was forced off its rightful line of running by approximately 3 horse widths. The head-on film showed that Veldt was put off balance due to the interference caused by Runaway Bride.
The committee was satisfied that the ground lost by Veldt exceeded the long head margin separating the two horses at the conclusion of the race and accordingly upheld the protest.
