As Miss Spratt admitted the breach we find the charge proved.

Penalty:

The Committee notes that the declaration of riders for 11 January closed on 8 January 2015 and Miss Spratt confirmed she had no engagements at that meeting.

Accordingly, Miss Spratt had her license to ride in races suspended for a period to commence after racing on 11 January and conclude after racing on 19 January 2015 (4 North Island days).

Facts:

Following the running of race 5, Atkinson & Donaldson Plumbing 1200,an Information was filed pursuant to Rule 638 (1)(d).The Informant, Mr Oatham, alleged that Miss Spratt allowed her mount PINZANO to shift out near the 500 metres when not clear of NEUTRON STAR (K Myers) which was checked.

Miss Spratt acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson identified on the video films PINZANO was racing in a 1 off position early in the home straight. He pointed out that with approximately 50 metres to run Miss Spratt allowed her mount to move out about 3 to 4 horse widths when placed under pressure. He said when PINZANO made contact with NEUTRON STAR Miss Spratt was only half a length in front of that runner. He added Miss Spratt made a small effort to straighten her mount but it was too little too late.

Miss Spratt told the Committee she was trying to straighten her mount but in her view the horse was reluctant to respond to her actions.

Submissions for Penalty:

Mr Oatham produced Miss Spratt’s record which showed 3 previous breaches under this Rule in the last 12 months. He described the level of carelessness was below mid-range and towards low. He submitted a 4 day suspension would be appropriate.

Miss Spratt advised that she had upcoming engagements at Ellerslie on 10 January, and any proposed suspension could commence after that.

In response to a question from the Committee, Miss Spratt confirmed that she had no intention of riding at Hokitika on 14 January 2015.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Spratt’s admission of the breach and we assess the level of carelessness as low end on the basis that the interference to NEUTRON STAR was minor. We assess Miss Spratt record in the last 12 months as average.

After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
