As the breach was admitted we find the charge proved.

Penalty:

Accordingly, and under the provisions of rule 1106 (2), we suspend Mr Lammas from riding in races which is to start after racing on 13 January and conclude after racing on 25 January (7).

Facts:

Following race 6 an information was filed pursuant to rule 638(1)(d).  The informant, Mr J Oatham alleged that Mr C Lammas permitted his mount NO NONSENSE to shift outwards near the 200 metres when not sufficiently clear causing QUEEN BOUDICCA to be severely checked.

Submissions for Decision:

Mr Robinson demonstrated the relevant video films which showed NO NONSENSE racing in a 2 wide position approaching the 200 metres.  Racing on his outside was QUEEN BOUDICCA (A Calder).  Mr Robinson said at this stage Mr Lammas was hard on the heels of the horse in front of him and there was no gap for him to take on his outside.  He added that Mr Lammas should have taken a hold but instead he angled his mount out approximately 1 horse width and directly into the line of QUEEN BOUDICCA which received a severe check. 

Mr Lammas in admitting the breach said at the time he was not travelling well but when his mount came on to the bit he angled out off the heels of the horse in front of him.  He said Mr Calder's mount appeared to over react to this movement but admitted he did cause the check.

Submissions for Penalty:

Mr Oatham produced Mr Lammas' record which showed 4 suspensions in the last 12 months.  He said that in regard to today's charge there was never a gap for Mr Lammas to take and he had forced a run which resulted in a severe check to Mr Calder.  He submitted a suspension of 6 to 8 days would be appropriate.

Mr Lammas said he had commitments up to and including 13 January.  In answer to a question from the committee as to where he intended riding after that he confirmed he mainly rode throughout the North Island and would not be going to Hokitika on 16 January.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  The only mitigating factor is Mr Lammas' admission of the breach.  However, and as explained to Mr Lammas, his record is of some concern and in today's charge he showed a total lack of regard to Mr Calder in angling out when insufficiently clear.  The committee independently assesses his carelessness to be in the mid to high range. After taking all the above factors into account we conclude an appropriate penalty is one of 7 days.
