As Mr Grylls admitted the breach we find the charge proved.

Penalty:

We grant Mr Grylls' request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, we impose a suspension on Mr Grylls which will commence after racing on 3 August and conclude after racing on 10 August 2013 (5 days).

Charge:

Following race 5, Best Drycleaners – Simply the Best 1400, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Mr Grylls angled his mount UNIVERSAL out when not sufficiently clear of HUNTER STREET near the 100 metres.

Mr Grylls acknowledged that he understood the nature of the charge and the Rule.

Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Facts:

Mr Jones demonstrated on the head-on film that Mr Grylls angled his mount out near the 100 metres when only one length clear. He said in doing so HUNTER STREET received quite a severe check.

Mr Grylls told the Committee that his mount was travelling very well and got onto the heels of the 3 horses in front of him quickly. He said his only option was to angle out, he conceded this movement resulted in HUNTER STREET being tightened for room and checked.

Submissions for Penalty:

Mr Oatham produced Mr Grylls' record which showed 2 previous breaches under this Rule in the last 12 months. He said this is a good record noting it is 8 months since Mr Grylls was charged with careless riding. He stated Mr Grylls had been co-operative with Stewards and should be given credit for his early admission of the breach. He noted Mr Grylls' mount was travelling very well when he was looking for racing room. However, he said, Mr Grylls was not entitled to shift out which caused a sharp check to HUNTER STREET. He described the level of carelessness as mid range and submitted a suspension at the low end as an appropriate penalty.

Mr Grylls said he had a good record from approximately 800 rides in the last 12 months. He advised us he had firm commitments up to and including 3 August and sought a deferment to any proposed suspension. He added that his manager was intending to book sufficient rides to warrant a trip to Christchurch on 7 August. He stated it was Grand National carnival week, with no race meeting scheduled for the North Island on that day.

In response to a question from the Committee, Mr Oatham had no objection if the Committee included 7 August in Mr Grylls' suspension.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Grylls’ admission of the breach and his good record for a busy rider in relation to this Rule. The aggravating factors are, we assess the level of carelessness is mid range noting that Mr Grylls was a bare length clear when moving out which resulted in HUNTER STREET receiving a short sharp check. We believe that Mr Grylls' carelessness was a factor in enabling him to win the race.

After taking into account all the above factors we consider an appropriate penalty is a 5 day suspension.
