In addition Ms Spratt is fined the sum of $500.
Facts:
Following the running of the FASTTRACK INSURANCE 1560, an Information was lodged by Stipendiary Steward, Mr A Coles against Jockey, Ms S Spratt alleging that Ms Spratt as the Rider of VISTOCK permitted her mount to shift out over the final 150 metres impeding THE GREEN GREMLIN.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Ms Spratt was present at the hearing and she advised that she understood the Rule and that she admitted the breach.
Stipendiary Steward, Mr A Dooley demonstrated the incident by use of the race films and showed the outward shift by VISTOCK and he said that the majority of the shift was late in the race. The films also showed VISTOCK making contact with THE GREEN GREMLIN. The combination of the shift and the contact had resulted in VISTOCK being relegated from first to second place.
Ms Spratt acknowledged Mr Dooley's interpretation of the films.
Submissions for Penalty:
Mr Coles said that the breach was in the mid range of seriousness although he acknowledged that Ms Spratt's actions had lead to the relegation of her horse.
He said that Ms Spratt had a very good record under this Rule and as a busy Rider she had not had a breach in the last 12 months. He did say that for the last 2 months of that period Ms Spratt had been out with injury.
Ms Spratt agreed that the incident was mid range.
Ms Spratt was asked if she was aware of the new penalties for careless riding and she said she had only recently become aware of them.
Ms Spratt was asked pursuant to Rule 1106 if she needed a deferment of her suspension and she said that she would like to take a 10 day deferment until after the conclusion of racing at Ruakaka on the 7 January 2021. She is aware that a 10 day deferment is available under NZTR's new policy. She said that she had a number of mounts for Mr McKee at Ruakaka.
Reasons for Penalty:
The race films showed that Ms Spratt had allowed her mount to shift outwards for at least 150 metres and in doing so had caused interference which resulted in her horse being relegated from first to second. She has admitted the breach but that was inevitable given the very clear film evidence.
She gets credit for the fact that as a busy Rider she has not had a breach of this Rule for 12 months.
The aggravating factor is the fact that her horse suffered a relegation from first to second.
The Committee however, are happy to view the interference as being mid range and for that the starting point penalty is a 5 day suspension and a fine of $500.
In respect to the suspension however the Committee imposes a 2 day uplift because of the relegation. TGhe Committee do however, give Ms Spratt a credit of 2 days because of her excellent record under this Rule and therefore the suspension will be one of 5 National Riding days plus a fine of $500.
The deferment of suspension as requested by Ms Spratt is granted.
Ms Spratt asked if the fine could be waived because the last day of the suspension was the first day of the upcoming Wellington Racing Club meeting. The Committee advised her that the fine was not only part of the new Penalty Policy but it had been imposed on other Riders and the Committee was not prepared to waive it.
