Facts:

Prior to the running of Race 1, an Information was filed with the Judicial Committee pursuant to Rule 534(1). The Informant, Mr Jones, alleged that Trainer Ms Mortimer failed to scratch CRAIGIEVAR by the required time.
Ms Mortimer endorsed the Information that she admitted the breach and she did not wish to be present at the hearing.
Mr Jones advised the Committee that CRAIGIEVAR had been accepted for Race 2 and Race 7. He said that by the scratching time of 7:30am, CRAIGIEVAR had not been scratched from Race 7. As a result, the Stewards attempted to contact Ms Mortimer and she returned their calls at approximately 9am. At that point CRAIGIEVAR was officially scratched from Race 7 where it was an emergency.
In explanation, Ms Mortimer told the Stewards that she forgot to scratch the horse from Race 7.

Submissions for Penalty:

Mr Jones said that Ms Mortimer had a clear record under this Rule and a similar breach happened on 17 March 2019 when Mr Jensen incurred a $150 fine. He submitted a fine in that vicinity would be appropriate.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.
The JCA Penalty Guide starting point is a $200 fine for a breach that relates to the late scratching of a horse after the 7.30am deadline where no horse is denied a start. That circumstance applies with this breach and we adopted that as the starting point.
The mitigating factors were Ms Mortimer's admission of the breach and her clear record under the rule. For these collective factors a $50 reduction in penalty was applied.
