Accordingly, pursuant to Rule 632 the Committee exercised their discretion and declared NABBED to be a non–starter.
Facts:
Following the running of Race 7, NZB Pearl Series 1400, Stipendiary Steward, Mr B Jones, lodged an Information requesting a ruling in relation to Rule 632 to establish whether the starting stall of NABBED mechanically failed causing her to lose ground.
Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placing’s was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”
Submissions for Decision:
Mr Oatham advised the Committee that NABBED (C Grylls) began awkwardly losing ground. He said on viewing the video footage it was apparent that the starting stall of NABBED had not caught correctly bouncing back and striking the filly in the head.
Mr Jones submitted that in the opinion of the Stewards NABBED should be declared a non–starter as the filly was clearly denied a fair start.
Mrs McGiven said the video films were very clear that NABBED definitely had her chances affected when being struck in the head as a consequence of her starting stall not catching.
Mr Grylls submitted the starting stall did open but it bounced back and hit NABBED in the head. He said as a result of this NABBED did not want a bar of it and tailed off.
Reasons for Decision:
The Committee carefully considered the submissions presented and viewed the video footage. It was clear on the video footage that NABBED’S starting stall did open in line with the rest of the field. However, NABBED’S starting stall did not catch as it is designed to do. This resulted in the starting stall springing back and striking NABBED firmly in the head. We accept no fault could be attributed to NABBED being slow of its own accord. We are satisfied that this materially prejudiced the chances of NABBED as she jumped away awkwardly and settled at the rear of the field after losing at least 4 lengths at the start. The films support Mr Grylls submission that NABBED was reluctant to hit out after the start when the filly became tailed off early in the race. We note NABBED beat only one horse in the race. The submissions of all parties were compelling in that NABBED lost ground at the start and was denied a fair start.
