Penalty:

Mr May’s Jockey’s Licence was suspended from 29 August through to the end of racing on 4 September 2020.

Facts:

Following the running of Race 5 (Campbell Infrastructure 1215) Information A12931 was filed with the Judicial Committee. It was alleged by the Informant that Mr May allowed his mount OTTAVIO to shift in when not sufficiently clear of PORSHABELLE which had to be restrained after clipping a heel.

Mr May said that he understood the Rule, the Charge and confirmed that he did admit the breach.

Ms Algar showed the film replays and said that Mr May shifted into the line of PORSHABELLE when not clear with the rider Ms Burdan taking a firm hold. Ms Algar added that PORSHABELLE clipped a heel.

Mr May said that Ms Burdan made the wrong decision as she could have eased and made the bend better. He said that he pleaded guilty for coming across when only one length clear.

Mr Jones said that Mr May had a clear record in New Zealand and placed the carelessness in the mid-range.

Mr May said that he had had 16 race rides in New Zealand. He said that he last rode in South Africa in January 2020 and had a fairly clean record there. Mr May asked that any suspension period could start after racing on 29 August 2020.

Reasons for Penalty:

The film evidence was crystal clear that Mr May allowed his mount to shift in when barely one length clear of PORSHABELLE. This resulted in PORSHABELLE clipping a heel, becoming unbalanced and making the bend awkwardly. It was observed that Mr May had looked to his inside at least twice before shifting.

The Chair placed the carelessness in the mid-range category and adopted a 4-Riding Day Suspension as a starting point. Taking into account Mr May’s record and admission of the breach, a 3-Riding Day suspension was considered to be a condign penalty.
