As Mr McNab admitted the breach we find the charge proved.
Penalty:
Accordingly, we impose a suspension on Mr McNab which will commence after racing on 28 January and conclude after racing on 9th February 2013 (5 days).
Charge:
Following race 3, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson alleged that SARAH POUR(M McNab) shifted in crowding CONCHITA (K Myers) WAI ITI (O Bosson) who were forced across the heels of PIPEDREAMS (C Grylls) losing ground passing the 150 metres.
Mr McNab advised the Committee prior to the hearing that he did not require any assistance.
Facts:
Mr Robinson demonstrated on the head on film Mr McNab riding his mount forward with the whip at the 200 metres when racing 5 off the rail. He said Mr McNab was too slow in straightening up his mount which shifted in. He believed it was not the worse piece of interference however, horses to Mr McNab's inside received crowding.
Mr McNab said his mount was running in under pressure. He conceded that he was too slow in his response.

Mr Williamson produced Mr McNab's record which showed 5 previous breaches under this rule in the last 12 months. He submitted that Mr McNab should be given credit for his admission of the breach and his frankness and co operation with Stewards. He said the level of carelessness was low to mid range. He reminded Mr McNab that when he is trying to win races he still has a duty of care to straighten his mount.
Mr McNab submitted he had commitments up to and including January 28 and requested his proposed suspension start after that date.
When asked by the Committee Mr McNab submitted that he was riding all over the North Island and had no intention of riding in the South Island.

The committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr McNab's admission of the breach and his honest and forthright manner when giving his evidence and submissions. However, the aggravating factors are Mr McNab's record which is below average and we assess the level of carelessness to be low to mid range. Taking into account all the above facts we assess an appropriate penalty to be 5 North Island days.
