Under the provisions of Rule 632 (2) the Committee declared TANGODANZER to have been a runner and confirmed its 5th placing in the race.

Facts:

Following the running of Race 6, Pomare Electrical 1215, Stipendiary Steward, Mr A Coles, lodged an Information with the Judicial Committee. He requested a ruling pursuant to Rule 632 (2) to determine whether TANGODANZER gained an advantage from its barrier stall opening slightly early.

Rule 632(2) states "If, in the opinion of the Judicial Committee, any horse gained an unfair advantage by its barrier stall malfunctioning and opening, or being forced, by such horse, open prior to the starter effecting a start, such horse may be declared a non-starter".

Submissions for Decision:

Mr Coles demonstrated the incident using the available video footage. He submitted it was clear that TANGODANZER’s barrier stall opened slightly early. However, the Stewards were of the view the horse did not gain an unfair advantage.

Mr Weatherley said that Mr Kamaruddin, the rider of TANGODANZER, anticipated the start which forced the barrier stall open slightly ahead of the others. He stated that his horse did not gain an unfair advantage.

Reasons for Decision:

The Committee considered the submissions presented and reviewed the video footage.

The video footage showed that TANGODANZER made firm contact with the front of its barrier stall. As a consequence the barrier stall opened fractionally ahead of all the others. It was clear that TANGODANZER began very awkwardly and as a result lost ground.

There was no video evidence to suggest that TANGODANZER gained an unfair advantage.
