FACTS:

--

Following race 3 a protest was lodged pursuant to rule 642 (1).  The informant, Mr Williamson alleged that SEA FLYTE placed third by the judge interfered with the chances of CARATACUS placed fourth by the judge.  This interference is alleged to have occurred in the home straight.

--

The official margin between third and fourth was a nose.

--

 

--

Mr C George, chief stipendiary steward demonstrated the video films which showed at the 150 metre mark SEA FLYTE angle out sharply for a run.  In doing so it was clear that this movement resulted in a check to CARATACUS who had its rightful line of running taken.  Mr George said CARATACUS was hampered and believed at the time of the interference CARATACUS was half a length ahead of SEA FLYTE.

Mr O Bosson, rider of CARATACUS, said he was finishing strongly and at the 150 metre mark he received a sharp bump from SEA FLYTE causing him to lose momentum.

Mr G Rogerson, trainer of CARATACUS, confirmed Mr George’s evidence and said his horse was denied its rightful line of running by the outward movement from SEA FLYTE.

Mr J McDonald, rider of SEA FLYTE, admitted he ducked out sharply but that his horse had over reacted and gone further out than he thought.

--

Mr Hillis, trainer of SEA FLYTE, agreed with Mr George apart from his statement saying that CARATACUS was ahead of SEA FLYTE at the time of interference.

--

Mr Williamson in summing up said CARATACUS clearly lost momentum as a result of the interference and believed that with the nose margin at the post the protest had a lot of merit.

--

DECISION:

--

The committee carefully considered all evidence and reviewed the video films.  The films confirmed that CARATACUS received a bump from SEA FLYTE when that horse was angled out for a run at the 150 metre mark.  This resulted in CARATACUS losing momentum and being put off balance.  At no stage was SEA FLYTE the required distance clear of CARATACUS when moving out.  From the point of interference CARATACUS finished strongly to finish within a nose of SEA FLYTE at the post.

For these reasons the committee is satisfied that if interference had not occurred CARATACUS would have beaten SEA FLYTE.

Accordingly the protest is upheld and the placings shall now be:
