As the breach was admitted we find the charge proved.
Penalty:
After taking all the above factors into account we impose a suspension under the provisions of Rule 1106(2)(A). Accordingly we impose a suspension on Mr Cameron from riding in races which is to start after racing on 20 April 2011 and conclude after racing on 29 April 2011 (5) days.

Facts:
Following Race 4 an Information was filed pursuant to Rule 638(1)(d). The Informant Mr J Oatham alleged that Mr M Cameron, rider of RUAPEHU RULER permitted his mount to shift in, dictating the line of CASTEL BENITO (C Ormsby). This caused CASTEL BENITO to move inwards and into the line of ANDI BLACK (Miss S Collett) who was crowded and checked. The interference occurred at the 1,000 metres mark.
Submissions for Decision:
Mr Coles demonstrated the video films and pointed out RUAPEHU RULER racing 5 wide approaching the 1,000 metres mark. It was clearly evident that Mr Cameron then started an inward movement and because he was not sufficiently clear of CASTEL BENITO (Mr C Ormsby) Mr Ormsby was forced inwards. Consequently Miss Collett, riding ANDI BLACK, had to take evasive action suffering quite severe check as a result. Mr Coles submitted that Mr Cameron was only 1¼ lengths clear of CASTEL BENITO when moving in.
Mr Cameron admitted he had made an error of judgement by not being sufficient clear.

Mr Oatham produced Mr Cameron’s record which showed 4 suspensions in the last 12 months which he submitted was only a fair record. He said Mr Cameron’s carelessness was in the mid range as ANDI BLACK had received a severe check.
Mr Cameron said he had commitments until after the Te Aroha meeting on 20 April 2011.
Reasons for Penalty:
The Committee considered all the evidence and submissions as presented. The only mitigating factor is Mr Cameron’s admission of the breach. This must be balanced against the level of carelessness which the Committee considers to mid range. Normally this breach would have warranted a 6 day suspension but because of the mitigating factor above we reduce this to one of 5 days.
