As Ms Cropp admitted the breach we find the charge proved.
Penalty:
We grant Ms Cropp's submission to seek a deferment to her suspension as per rule 1106(2).
Accordingly, we impose a suspension on Ms Cropp which will commence after racing on 31st March 2012 and conclude after racing on 7th April 2012 (4 days).
Charge:
Following race 7 an information was filed pursuant to Rule 638(1)(d). The informant Mr Oatham alleged that Ms Cropp permitted her mount FANCY PANTS to shift outwards near the 250 metres when not sufficiently clear of ROCKFIELD BELLE (M Coleman) which clipped a heel and blundered.
Facts:
Mr Oatham demonstrated the incident by using the video films. He pointed out to the committee on the head on film that Ms Cropp allows her mount to shift out at the 250 metres when not the required distance clear. The side on film showed that Ms Cropp was only 1 length clear when shifting ground. This resulted in ROCKFIELD BELLE clipping a heel and blundered.
Ms Cropp told the committee that she believed the shift was minor.
Submissions for Penalty:
Mr Oatham submitted that Ms Cropp recently returned to riding in New Zealand. He produced Ms Cropp's Australian race riding record which showed 3 charges under this rule in the last 12 months. He believed the level of carelessness was in the low to mid range and rated her riding record as good. He submitted that a 4 – 5 day suspension would be an appropriate penalty.
Ms Cropp submitted that she had firm commitments up to and including 31st March 2012 and was seeking a deferment to fulfil those engagements. Ms Cropp acknowledged when asked by the committee that she rides only in the North Island and had no intention to ride at Banks Peninsula meeting on 3rd April 2012.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factor is Ms Cropp's admission of the breach. However this has to be balanced against the fact that Ms Cropp was only 1 length clear when shifting ground. We assess the level of carelessness to be low range and assess Ms Cropp's overall riding record to be good.
