Decision:

Following Race 2 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr J Oatham that Jockey K Myers the rider of JUST LOOKING allowed her mount to shift inward in the home straight into the line of OUR MAESTRO causing that runner to be checked.

Following Race 2 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr J Oatham that Jockey K Myers the rider of JUST LOOKING allowed her mount to shift inward in the home straight into the line of OUR MAESTRO causing that runner to be checked. Ms Myers pleaded guilty to the charge and was represented by her employer Mr S Autridge.

No new evidence was produced as the incident was fully viewed and discussed at the earlier enquiry when Ms Myers' mount JUST LOOKING was relegated from 2nd to 4th.

Decision:

Mr Autridge asked the Committee to consider Ms Myers admission of the charge and also the fact that the inward movement was minimal.

--

Ms Myers also said her movement was not great and did not have any forthcoming engagements for the Committee to consider.

--

Mr Oatham produced Ms Myers record showing her 2 last charges ? 22/4/06 ? 3 days and 13/5/06 ? 3 days.

--

He believed that as a relegation occurred a suspension was appropriate even allowing for the fact that the inward movement was minimal.

--

The committee considered all submissions and agree for the foresaid reasons a suspension is the correct penalty.

--

Accordingly we suspend Ms Myers from after racing on the 27th September and concluding after the finish of racing on the 5th October 2006 (4 Days).
