Following Race 2 an Information was filed pursuant to Rule 876(1) when it was alleged by the Informant, Mr J Oatham, that JUST LOOKING interfered with the chances of OUR MAESTRO in the home straight

Following Race 2 an Information was filed pursuant to Rule 876(1) when it was alleged by the Informant, Mr J Oatham, that JUST LOOKING interfered with the chances of OUR MAESTRO in the home straight. At the commencement of the enquiry Mr Oatham confirmed that the connections of both horses were informed of the protest.

Present at the enquiry were Stipendiary Stewards Mr Oathan and Mr Goodwin. OUR MAESTRO represented by trainer Mr K Myers and rider Mr d Walker. JUST LOOKING represented by Nicky Marshall and rider K Myers. Mr Autridge was also present representing Kelly Myers.

--

The official margins were a neck, 1 length and half a head between 3rd and 4th.

--

JUST LOOKING finished 2nd in the race and OU MAESTRO finished 4th.

--

Mr Goodwin demonstrated the video films and showed that soon after turning for home JUST LOOKING moved inwards and took the line of OUR MAESTRO on its inside which necessitated rider Mr Walker to check his mount and lose valuable ground.

--

Mr K Myers was adamant that his horse OUR MAESTRO would have finished 3rd if the gap had not closed. Mr Walker and Mr Autridge had nothing to add.

--

Miss Myers, rider of JUST LOOKING admitted that her mount did affect the chances of the 4th horse.

--

Mr Oatham in his statement said that Mr Walker was entitled to be where he was and it was clear that JUST LOOKING was not sufficiently clear when moving inwards. He believed the protest should be upheld.

Decision:

The Committee viewed all video films again and were clearly of the opinion that interference did occur when JUST LOOKING moved inwards and took the line of OUR MAESTRO.

--

This interference caused Mr Walker to check his mount and change ground losing valuable ground as a result. The Committee are of the opinion that this interference affected the chances of OUR MAESTRO finishing in a better place.

--

In applying our discretion the Committee has considered the margin between 3rd and 4th being half a head, the ground lost by OUR MAESTRO and because of these reasons the protest was upheld.
