Accordingly, Mr Studd had his license to ride in races suspended for a period to commence after racing on 25 August and conclude after racing on 30 September 2018.
Facts:
Following the running of race 2, The Patrons Maiden Hurdle, an Information was filed pursuant to Rule 636 (1)(b). The Informant, Mr Oatham, alleged that Mr Studd failed to take all reasonable and permissible measures from near the 700 metres to ensure that RESULT MERCHANT was given full opportunity to obtain the best possible placing.
Mr Studd said that he understood the Rule and confirmed his admission of the breach.
Rule 636(1) (b) provides:
A person:
(b) being the Rider of a horse in a Race, must take all reasonable and permissible measures throughout the Race to ensure that his horse is given full opportunity to win the Race or to obtain the best possible finishing place.
Mr Oatham advised the Committee that RESULT MERCHANT was retired from the race by Mr Studd prior to jumping the last 3 hurdles. He said the Stewards were concerned how quickly Mr Studd retired his mount from the race. He said by time the Stewards had reviewed the race films and interviewed Mr Studd RESULT MERCHANT had left the course and the Stewards were unable to get the Veterinarian to carry out a post-race check on the horse.
Mr Oatham then advised the Committee that he had spoken to RESULT MERCHANT’S Trainer, Ms Cave and she had informed him that there was no issues with how the horse had pulled up after race. Further he advised that there was no suggestion from Mr Studd that there was any abnormality with RESULT MERCHANT apart from it having a tendency to lay in.
Mr Jones demonstrated the incident using the available video footage. He pointed out that passing the 1000 metres RESULT MERCHANT was racing towards the rear of the field. He identified that near the 800 metres RESULT MERCHANT was making ground when being ridden with vigour and the horse was responding. He said it was clear that shortly after that point Mr Studd stopped riding his mount with any vigour and for no reason other than his mount laid in a bit. He said the Stewards were concerned that Mr Studd was racing in 5th place and making ground on the 4th placed horse when Mr Studd relaxed his ride. He pointed out that WILLIJOHNMCBRIDE and CASHEL were racing behind RESULT MERCHANT passing the 700 metres and they ran 2nd and 6th respectively at the finish. He said Mr Studd should have continued to ride his mount forward in the race. In conclusion he said that when Mr Studd relaxed his ride RESULT MERCHANT stopped quickly.
Mr Studd told the Committee that near the winning post on the first round he had to draw the whip on his mount. He said the Trainer, Ms Cave had told him that RESULT MERCHANT did hang in its races and it had been sacked by other Trainers because the horse was not genuine. He said that RESULT MERCHANT was under a ride from the 1000 metres, the horse did respond and it was hanging. He added that when he stopped riding RESULT MERCHANT, it eased up, he lost ground and he pulled the horse up.
Submissions for Penalty:
Mr Oatham said that Mr Studd had 1 previous breach of this Rule on 18/6/2016 which incurred a 2 week suspension. He added that Mr Studd had been charged on 26/7/2018 for relaxing his ride and failing to ride his mount out to the end of the race when finishing in 4th place and this incurred a 3 and ½ week suspension.
Mr Oatham said in today’s case RESULT MERCHANT does have some issues with the horse being pulled up in its last 2 starts and the horse has a tendency to give up. He said the Stewards were concerned today that RESULT MERCHANT was making ground when being ridden forward passing the 800 metres and Mr Studd then stopped riding his mount so quickly. He believed that it was unacceptable for Mr Studd to stop riding and retire his mount from the race. He said the JCA Penalty Guide starting point for a breach of this Rule is 6 weeks. He submitted that a 3 to 4 week suspension would be appropriate for a Jump/Highweight rider.
Mr Studd said that he had just come back from a suspension and he didn’t want to be suspended again. He said that he had confirmed rides in the Great Northern Hurdles and Steeples on 9 September. He added that he would have a full book of rides for the remainder of the season.
Mr Studd accepted that the Great Northern’s fell outside the 7 day deferment Rule. He was also cognisant that there were only 4 national riding days available for Jump/Highweight riders until the end of the season.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the video footage the Committee established that Mr Studd was riding RESULT MERCHANT forward near the 800 metres and his mount was making good progress. However, shortly after that point we observed that Mr Studd clearly relaxed his ride for no apparent reason when racing in 5th place. Near the 700 metres RESULT MERCHANT was racing 1 length behind I’M BRONSON which was in 4th place. It is also significant to note that near the 700 metres WILLIJOHNMCBRIDE was racing 4 lengths in arrears of RESULT MERCHANT and WILLIJOHNMCBRIDE ran on to finish in 2nd place. It was evident that Mr Studd continued to relax his ride and he showed no vigour at all with his mount losing ground sharply. It is relevant to note that at the 600 metres WILLIJOHNMCBRIDE was racing 1 length behind RESULT MERCHANT. Mr Studd was clearly standing up in the saddle at the 600 metres and he then directed his mount to the outside of the track. Mr Studd retired RESULT MERCHANT from the race at the top of the home straight and he failed to jump the last 3 hurdles.
The Committee notes that there was no evidence from Mr Studd to suggest that RESULT MERCHANT was lame/sore. Riders are not obliged to ride their mounts out vigorously with the whip, but they have an obligation to continue and urge their mounts with hands and heels to the end of the race irrespective of the horses racing record. It was obvious that Mr Studd failed to take all reasonable and permissible measures from near the 700 metres to ensure that RESULT MERCHANT was given full opportunity to obtain the best possible finishing place.
The JCA Penalty Guide starting point for a breach of this Rule is 6 weeks. However, after having regard for the limited riding opportunities available to Jump/Highweight riders a reduced starting point was adopted in this case.
The aggravating factors were Mr Studd had no genuine reason for sitting up near the 700 metres and relaxing his ride for approximately 200 metres before retiring his mount from the race. The Committee deemed Mr Studd’s level of culpability to be mid to high range. The Committee is concerned with Mr Studd’s record for similar type of offences under Rule 636. Of significance Mr Studd was suspended from the close of racing on July 28 and up to and including 24 August 2018 for failing to ride his mount out to the end of the race. This Committee would have expected the most recent penalty imposed on Mr Studd to act as a deterrent. However, in his first race day ride back he breached this Rule.
The only mitigating fact was Mr Studd’s admission of the breach for which he was given credit.
The importance of the upcoming Prestige Jumping races and the meeting scheduled for Jump/Highweight riders on 30 September should have been in the forefront of Mr Studd’s mind, causing him to be more determined not to breach any Rule.
The Committee was mindful when considering an appropriate penalty that there were only 4 national Jump/Highweight race meetings until the end of the season.
After taking into account all the above factors the Committee considered the circumstances of the breach to be so serious that an appropriate suspension was 5 weeks.
