Following Race 8 an Information was filed pursuant to Rule 858 (1) (C).  The Informant, Mr A Coles, alleged that Mr Ormsby, Mr Ihaka and Mr Enyon made hand contact with each other prior to weighing in.

Following Race 8 an Information was filed pursuant to Rule 858 (1) (C).  The Informant, Mr A Coles, alleged that Mr Ormsby, Mr Ihaka and Mr Enyon made hand contact with each other prior to weighing in.

All three pleaded guilty and the charges were heard as one.

Mr Coles said it was clearly visible and confirmed by video footage that the 3 riders concerned, upon pulling up, congratulated Mr Ormsby by doing Hi Fives and handshakes.  He said this was unacceptable and contrary to the rules.  He said in their favour that it was a first offence under this rule for all 3, that they pleaded guilty and were remorseful.  He submitted a fine of $150 would be appropriate.

All 3 riders explained they were good friends and just acted in the heat of the moment.

DECISION:

The Committee explained to the hearing they were satisfied that the breach in this case did not prejudice the weigh in process and their actions did not relate to their mounts in any way.  However they explained to the riders it was how their actions could be perceived by the public that was the main concern and these actions prior to weighing in cannot be condoned.

--

Their guilty pleas, their genuine remorse and first time charges were all taken into account before the Committee imposed a fine of $150 on each rider.
