As the breach was admitted we find the charge proved.

Accordingly after taking all the above into account we impose a fine of $150.

Facts:

Following race 6 an information was filed pursuant to rule 638(3)(b).  The informant Mr Coles alleged that Mrs L Satherley used the whip on LITTLE ALFIE BROWN in an excessive manner.

Submissions for Decision:

The committee was shown video footage by Mr C George.  Mr Coles then advised the committee that Mrs Satherley struck her mount 15 times prior to the 200 metre mark without giving the required respite of 6 strides.

Mrs Satherley said that it was an error of judgement on her part but pointed out that she did give respite for 3-5 strides.  She also said her mount was lazy and the heavy going was a factor in her actions.

Submissions for Penalty:

Mr Coles said this was Mrs Satherley's first whip charge in the last 12 months and a breach of this nature usually attracted a fine of $200.

Mrs Satherley offered no submissions as to penalty.

Reasons for Penalty:

The committee considered all evidence and submissions.  Mitigating factors are Mrs Satherley's admission of the breach and her clear record under this rule.  We are satisfied that Mrs Satherley did give some respite for 3 - 4 strides and we accept this was not a case of continuous striking.  For those reasons we find this breach at the lower end of carelessness.
