Facts:
Following race 5 an information was filed pursuant to rule 610(4). The informant Mr A Coles alleged that Mr A Kuru had a modified vest in his possession.
Submissions for Decision:
Mr Coles told the committee that the stewards found that Mr Kuru was wearing a vest which had been modified. Mr Coles produced the vest and showed the committee that the lower pads had been removed.
Mr Kuru said he understood the rule and his obligations but had removed the pads for comfort reasons.
Mr Barry on behalf of Mr Kuru said Mr Kuru had removed the pads over a year ago. He said he was naive but there was no malicious intent in his actions.
Submissions for Penalty:
Mr Coles submitted that a breach of this rule normally attracted a fine of $200.
Mr Kuru made no submissions as to penalty.
Reasons for Penalty:
The committee considered all submissions and evidence. While we have some sympathy that Mr Kuru is an amateur rider it was pointed out to him that his obligations under the rules of racing have equal application to amateur riders.
