Following Race 10 Stipendiary steward A R Coles filed Information 41424 requesting a ruling under Rule 912 (1) as to whether the horse ROYAL INTERLUDE was denied a fair start.

Jockey B Sargent who rode ROYAL INTERLUDE stated that his gate failed to open at the start at the same time as those for the other runners and by the time it had opened he had lost two or three lengths on the rest of the field. He said he had found it necessary to force his way out and his mount raced throughout the race at the rear finishing third last.

Stipendiary Steward J P Oatham demonstrated the incident on video and confirmed what Mr Sargent had said. There was, he said, clearly a mechanical failure and it was through no fault of the horse that it failed to get away on terms with the rest of the field and subsequently had not taken an effective part in the race.

Having considered the evidence and viewed the video the Committee is satisfied that ROYAL INTERLUDE was prevented from taking an effective part in the race as a result of mechanical failure of the gate on its starting stall which denied it a fair start and materially prejudiced its chances; excluding the possibility of it being slow away by its own accord. The Committee therefore ordered a refund of all tickets invested on ROYAL INTERLUDE on production of those tickets and ruled accordingly on the information.
