Following race 9 a protest was lodged by Mr R Priscott pursuant to Rule 876(1) alleging that FORCEFUL or it’s rider, placed 1st by the Judge, interfered with the chances of HE’S GOT RHYTHM placed 4th by the Judge



Following race 9 a protest was lodged by Mr R Priscott pursuant to Rule 876(1) alleging that FORCEFUL or it’s rider, placed 1st by the Judge, interfered with the chances of HE’S GOT RHYTHM placed 4th by the Judge. The interference occurred in the final straight.

The Judges placings were:

--

!st (10) FORCEFUL

2nd (15) VANNISTA BELLE

3rd (10)THE RHUMBA)

--

4th (6) HE’S GOT RHYTHM

--

The margins were a head between 1st & 2nd, a head between 2nd & 3rd, and ¾ length between 3rd & 4th.

--

FORCEFUL was represented by Ms K Fursdon and Mr J Waddell and Mr R Priscott with Mr C Grylls represented HE’S GOT RHYTHM.

Mr Priscott demonstrated on the video where, soon after entering the straight, FOREMOST moved out and took the line of HE'S GOT RHYTHM. He showed Mr Grylls checking his mount for 2 – 3 strides. He then showed where, as they approached the finish, HE’S GOT RHYTHM, again receiving a small check.

Mr Grylls supported Mr Priscott and said he felt that he lost ½ a length in the 1st incident before being tightened again prior the the winning post.

Ms Fursdon and Mr Waddell both accepted that there had been some movement at the top of the straight but the 2nd incident had not been caused by their horse.

--

Stipendary Steward Mr. A Coles said that although HE’S GOT RHYTHM was held up for 2 – 3 strides at the top of the straight he was not making any progress in closing the gap on the 3rd placed THE RHUMBA at the finish where the margin was ¾ length.

DECISION

--

Rule 861(1) requires the committee to firstly consider if interference did take place, and then, if so, whether that interference has cost the horse a chance of finishing in a better place.

--

We are satisfied that, on the evidence presented, interference did occur to HE’S GOT RHYTHM at the top of the straight and that it was caused by the outward movement of FORECEFUL.

--

We agree that HE’S GOT RHYTHM did receive a further check close to the winning post but this was not caused by FORCEFUL who was maintaining a straight line.

--

After taking into account the perceived distance lost by HE’S GOT RHYTHM in the 1st incident, the way he finished the race, and the margin of ¾ length between 3rd & 4th we dismiss the protest and judges placings stand.
