Charge:

Apprentice Jockey  T Arumugam was charged with using the whip on Divine Miss in an excessive manner during the running of Race 8.

Facts:

Apprentice Jockey Mr T Arumugam appeared to answer a charge of excessive use of the whip which occurred during the running of Race 8 at the Paeroa meeting of 27th July 2011.

Stipendiary Steward Mr Oatham told the committee that Mr Arumugan"s employer was not available for the hearing and that Mr Arumugan had taken advice and wished to admit the charge. 

Mr Arumugan confirmed this and his admission of the breach.

Mr Oatham referred to video footage of the race from the home turn and indicated where Mr Arumugan had used the whip on fourteen occasions prior to the 200 metre mark.  His extravagant whipping action highlighted the breach and the stewards recommended that Mr Arumugan seek assistance to modify his style.

Mr Arumugan agreed with the Stewards assessment.

Submissions for Penalty:

Mr Oatham submitted that a fine in the region of $200 to $250 was appropriate.  Mr Arumugam was an apprentice with one previous breach of this rule in the previous 12 months and had admitted the breach.

Mr Arumugam had no submissions on penalty.

Reasons for Penalty:

Mr Arumugan is an apprentice jockey who has one previous breach of this rule which attracted a fine of $150.  The whipping action had highlighted the breach which the Stewards assessed at the lower end of the scale.  The breach had been admitted and a fine was appropriate.
