FACTS:
--Following race 2 an Information was filed pursuant to Rule 648 (3) requesting a ruling in that H Kasim, rider of FLETCHER BAYBE, weighed in more than .5 kg light of his weigh out weight.
----
SUBMISSION(s):
--Mr Oatham explained to the Committee that, after the winner of Race 2, FLETCHER BAYBE weighed in, his Jockey H Kasim was found to be .6 kg under his weighed out weight of 51.5 kg. This weight took into account his apprentice claim of 3 kg. These weights and the resulting error were confirmed by the Clerk of the Course Mr C Neale.

Mr Faber, the trainer of FLETCHER BAYBE, said that after the weigh in he found he had omitted to include a towel which he had weighed out with.
----
Mr Oatham in summing up said the rule was clear that .6 kg was in excess of the allowable discretion of -5 kg and the Committee had no option but declare the horse be disqualified.
----
DECISION:
--The Committee considered the evidence as presented and is clearly satisfied the weigh in procedure and resultant .6 kg discrepancy were correct. Because the rule only allows .5 kg as a discrepancy the Committee has no option but to order the horse FLETCHER BAYBE to be disqualified.

The placings shall now be:
--1st No 1 DUKE
--2nd No 10 CAYUSE
--3rd No 8 SECOND IN COMMAND
--4th No 7 NUMERO DE LAGO
--5th No 9 SUMMERSKI
