As the breach was admitted we find the charge proved.

Penalty:

After taking all the above factors into account we impose a fine of $300 and order Mr Shirihama to forfeit his riding fee. Further we order the disqualification of A Soldiers Leap from race 1.

Facts:

Following Race 1 an information was filed pursuant to rule no 647(1).  The informant Mr M Williamson alleged that Mr S Shirihama failed to weigh in after race 1 for the horse A Soldiers Song, which was placed 5th by the judge.

Submissions for Decision:

Mr Williamson told the committee that just after the jockeys had weighed in for race 1 it was discovered that the 5th placed rider Mr S Shirihama had failed to do so.  This was detected by assistant Stipendary Steward Mr W Robinson but it was too late as Mr Shirihama had already put his gear down in the jockeys' room.

Mr Shirihama said he simply forgot in the heat of the moment.

Mr Autridge in representing Mr Shirihama said there was a lot going on after the race as there had been a fall and there was concern about the state of the track. He believed Mr Shirihama's carelessness was minimal.

Submissions for Penalty:

Mr Williamson said Mr Shirihama had no previous weigh in issues and submitted a $300 - $400 fine would be appropriate. He asked the committee for disqualification of A Soldiers Song from the race and asked the committee to consider whether Mr Shirihama should forfeit his riding fee.

Mr Autridge said that punters had not missed out as the horse was only 5th and any penalty should be minimal.

The committee considered all the evidence and submissions. In Mr Shirihama's favour are his admission of the breach and that this was his first weigh in charge. Another mitigating factor was the confusion arising from the state of the track which resulted in a fall. However as explained to Mr Shirihama it is imperative for all riders to remember their obligations and he was fortunate that in this case he was only 5th or he would have been facing a much more serious penalty.
