Following race 6 an information was filed pursuant to Rule 871(1)(d) by the informant, Mr J Oatham.  He alleged that over the final 200 metres L Macfarlane permitted his mount DIWALI to shift out when not sufficiently clear of SACRED SUN who was hampered and then checked.

Following race 6 an information was filed pursuant to Rule 871(1)(d) by the informant, Mr J Oatham.  He alleged that over the final 200 metres L Macfarlane permitted his mount DIWALI to shift out when not sufficiently clear of SACRED SUN who was hampered and then checked.

Mr Macfarlane admitted the breach.

Mr Oatham demonstrated the video films and showed that soon after jumping the last fence Mr Macfarlane on DIWALI commenced an outward movement.  He moved out at least 4 horse widths until he came into contact with SACRED SUN.  He momentarily straightened his mount, but then continued riding and taking the line of SACRED SUN when not sufficiently clear.  SACRED SUN received a considerable check as a result.

Mr Oatham said Mr Macfarlane had an excellent record and was fully co-operative with the Stewards.  He said Mr Macfarlane’s degree of carelessness was quite high and deserved a term of suspension.

Mr Macfarlane had nothing to add other than tell the Committee of his commitments.

PENALTY:

--

Before imposing penalty the Committee note the jumping season concludes on 28 September.  Accordingly we suspend Mr Macfarlane from after the conclusion of racing on 21 September until after the conclusion of racing on 28 September (2 days).  Normally this offence would warrant at least a 4 day suspension so therefore in addition to the suspension we impose a fine of $500.
