Decision: Following race 5 an information was filed by the informant Mr J Oatham requesting a ruling under Rule 870(1).  The request was to ascertain whether VOLKSWAGIN and GOLDEN CRUSADER went around the wrong side of the marker pegs and should be disqualified

Following race 5 an information was filed by the informant Mr J Oatham requesting a ruling under Rule 870(1).  The request was to ascertain whether VOLKSWAGIN and GOLDEN CRUSADER went around the wrong side of the marker pegs and should be disqualified.

Present at the inquiry were:

--

Mr J Wheeler, trainer, and jockey Mr A Browne (VOLKSWAGIN, third).

--

Mr M Rogers, trainer, and jockey Miss J Lewis (GOLDEN CRUSADER, fourth).

--

 

--

Mr Coles demonstrated the video films and showed as the horses entered the back straight, GOLDEN CRUSADER and VOLKSWAGIN go inside the marker pegs.  This fact was not challenged.

Mr Oatham said the Stipendiary Stewards had inspected the course this morning and noted the placing of the markers which were being used for the first time.  All jockeys were addressed before the race and were told of the markers and advised to exercise care.

Mr J Wheeler, trainer of VOLKSWAGIN, said the Committee had no option other than to disqualify both runners.

--

 

--

Mr Rogers, trainer of GOLDEN CRUSADER, expressed concern about the placing of the markers.

--

 

--

Both riders said pressure from the outside caused the problem, and the placing of the markers was a concern.

--

 

--

Mr Oatham in his submission said the markers were not in the wrong place and felt that when the leader at the time, MONYMONY ran off, this may have contributed to the two runners in question running inside the markers.

--

The Committee considered all evidence and while having considerable sympathy with the connections of the two horses concerned, the Rule clearly states that any runner which runs on the wrong side of the marker shall be disqualified.

--

The Committee told all present at the inquiry that the Stipendiary Stewards would discuss any future placings of the markers with the Club.  Accordingly we order that VOLKSWAGIN and GOLDEN CRUSADER be disqualified and the placings are now:
