Decision: Following race 6 the informant filed an information alleging that Mrs L Satherley, rider of MIDDAY HERO, allowed her mount to shift out over the final 200 metres causing interference to IMPASSE (M Hills).

--

Following race 6 the informant filed an information alleging that Mrs L Satherley, rider of MIDDAY HERO, allowed her mount to shift out over the final 200 metres causing interference to IMPASSE (M Hills).  A protest in respect of the alleged interference had earlier resulted in the relegation of MIDDAY HERO from first placing to second placing.

Mrs Satherley did not admit the breach.

Mr Williamson demonstrated the video films and showed Mrs L Satherley allow her mount to drift out approximately 5 horse widths in the final straight.  This outward movement dictated the line of IMPASSE in the run up the straight.  This resulted in two points of contact with the final one resulting in IMPASSE receiving quite a sharp check.  He said at no stage did Mrs Satherley stop riding.

Mr M Hills, rider of IMPASSE, said he received buffeting on two occasions from MIDDAY HERO and his mount was dictated approximately four horse widths outwards.  This definitely affected her chances.

Mrs Satherley called Mrs Laing, trainer of MIDDAY HERO, who told the Committee the horse was having its first start, was immature mentally and erratic in its nature.

Mrs Satherley in her statement said her mount was very erratic and wanted to lug out on IMPASSE.  She said in her opinion it was not careless, and she had stopped riding after making contact.

Mr Oatham told the Committee Mrs Satherley had ample warning of the horse’s tendencies and her efforts to straighten were not effective.  He said she continued to ride forward at all times.

The Committee is clearly of the opinion that Mrs Satherley did allow her mount to move out into the line of IMPASSE when insufficiently clear of that runner.  It was clear to us that she did not stop riding and any corrective measures were negligible and not effective.  Accordingly we find the charge proven.

PENALTY:

--

Mr Oatham informed the Committee of Mrs Satherley’s record showing two previous charges in the last six months, and recommended a 4 – 6 day suspension.

Mrs Satherley said she had no commitments after today’s racing.

--

The Committee considered these submissions and before imposing penalty considered the following:

--

 

--

1.            Mrs Satherley’s record.

--

2.            Mrs Laing’s submissions.

--

3.            The distance over which the interference occurred.

--

4.            A relegation resulted through Mrs Satherley’s carelessness.

--

 

--

Accordingly we impose a suspension to start at the conclusion of today’s racing and conclude after racing on 24 May (6 days).
