Decision: Following race 1 an information was filed pursuant to Rule 876(1). This protest was lodged by the informant, Ms J Rathbone, rider of POLE. She alleged that GENERAL MAC placed third by the Judge interfered with her mount’s chance which finished fourth.

--Following race 1 an information was filed pursuant to Rule 876(1). This protest was lodged by the informant, Ms J Rathbone, rider of POLE. She alleged that GENERAL MAC placed third by the Judge interfered with her mount’s chance which finished fourth. This was alleged to have occurred in the final 50 metres.

Mr A Coles demonstrated the video films and showed where GENERAL MAC (M Browne) moved out taking the line of POLE approximately 50 metres from the post. He said this caused Ms Rathbone, rider of POLE, to check off the heels of GENERAL MAC.

Ms Rathbone said she thought her horse was going to make ground when she was forced outwards by GENERAL MAC. She was unsure whether this cost her third placing.

Ms Browne, rider of GENERAL MAC, admitted she moved out, but also believed POLE moved in slightly contributing to the interference.

Mrs A Browne, trainer of GENERAL MAC, believed the horse on the outside of POLE also moved in, further contributing to the incident.

Mr Oatham said it was clear that there was interference suffered by POLE which caused a check to Ms Rathbone’s mount. However, the 1 ¼ length margin between third and fourth had to be considered by the Committee, with any doubt meaning the status quo should remain.

The Committee carefully considered all the evidence and reviewed the video films.

We are satisfied that POLE did receive a check when GENERAL MAC moved out into its line in the final 50 metres. However, taking into account the margin between the two horses at the post of 1 ¼ lengths, the manner in which both horses finished and the doubt expressed by Ms Rathbone as to whether she would have finished in a better placing, we do not believe the chances of POLE finishing in a better place were affected, accordingly the protest is dismissed and the Judge’s placings shall stand.
