Following race two an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson, alleged that Mr E Dalley permitted his mount LITTLE TURBO to shift inwards near the 150 metres when not sufficiently clear of IMAT THEBAR (S Collett). This caused IMAT THEBAR to be taken into the line of DYNAMITE (J Morris) who clipped a heel and blundered.

Following race two an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson, alleged that Mr E Dalley permitted his mount LITTLE TURBO to shift inwards near the 150 metres when not sufficiently clear of IMAT THEBAR (S Collett). This caused IMAT THEBAR to be taken into the line of DYNAMITE (J Morris) who clipped a heel and blundered.
Mr Dalley was represented by Mr G Alton.
--Mr Dalley pleaded guilty to the charge.
--Mr Oatham demonstrated the video films and pointed out to the Committee at a point near the 150 metres, LITTLE TURBO ridden by Mr Dalley, shift inwards taking the line of IMAT THEBAR when insufficiently clear of that runner. Mr Oatham said SHI KIN DANCE (M Tanaka) moved out slightly contributing to the interference. He also said Miss Morris did try and push forward into a somewhat tight gap.
--Mr Dalley said he believed Miss Morris should not have attempted to push into the gap. However, he admitted his horse rolled in under the whip and did tighten the runners inside him.
--Mr Alton said Mr Dalley did have the whip in his right hand, but conceded Mr Dalley’s mount did roll in.
--PENALTY SUBMISSIONS:
Mr Williamson said this was Mr Dalley’s second charge in 12 months, with his previous suspension being on 29 April 2009 (four days). He said because of the mitigating factors outlined above he believed this offence was at the lower end of carelessness.
Mr Dalley said he had commitments up to and including 21 January 2010.
--PENALTY:
The Committee carefully considered all evidence and submissions. Mitigating factors taken into account were Mr Dalley’s excellent record, his guilty plea, and the contribution to the incident by Mr Tanaka. However, Mr Dalley did allow his mount to move in when insufficiently clear and in doing so made no attempt to straighten.
Accordingly we impose a suspension on Mr Dalley from riding in races which is to start after racing on 21 January and conclude after racing on 27 January 2010 (four days).
