Decision: Following race 3 an Information was filed pursuant to Rule 876(1) when it was alleged by the Informant, Mr J Oatham, that CROM ABU placed third by the Judge interfered with the chances of SETON BAY placed fourth by the Judge.
DECISION & REASON:
--Following race 3 an Information was filed pursuant to Rule 876(1) when it was alleged by the Informant, Mr J Oatham, that CROM ABU placed third by the Judge interfered with the chances of SETON BAY placed fourth by the Judge. The interference occurred in the final 100 metres. All parties were informed of the protest.

The margin at the post was a nose between third and fourth.

Present at the inquiry were:
--CROM ABU – rider D Johnson, trainer Mr R McRae.
--SETON BAY – rider T Thornton, trainer Mr R Ritchie.

Mr M Williamson demonstrated the video films and showed that with approximately 100 metres to run CROM ABU moved out quite sharply and in doing so took the rightful line of SETON BAY. Mr Williamson said that after the interference SETON BAY finished very strongly making up a length in the final 50 metres.

T Thornton, rider of SETON BAY, said she was certainly going to go past Danielle Johnson and the interference definitely cost her third placing.

D Johnson, rider of CROM ABU, said her mount was lugging out the whole way and she thought that Trudy Thornton had also moved in.

Mr R McRae confirmed Ms Johnson’s statement and believed both horses were doing their best work at the finish. He said that the last stride before CROM ABU moved out that Ms Thornton’s mount had moved in.

Mr J Oatham, Stipendiary Steward, said there had clearly been outward movement from CROM ABU and maybe some slight movement from SETON BAY. He said Ms Thornton was hampered for some strides and given the nose margin between third and fourth believed the protest should be upheld.

The Committee carefully considered all evidence and reviewed the video films. We are satisfied that SETON BAY did suffer interference when CROM ABU moved into its line without being the required distance clear. As a result of this Ms Thornton had to stop riding for a few strides. We believe this interference did affect the chances of SETON BAY finishing in a better place. Important in our decision to uphold the protest was the nose margin and the strong finish of SETON BAY who was over-hauling CROM ABU very quickly. Accordingly the protest is upheld and the placings shall now be:
--2 RIVER PEGASUS first
--4 TOBERMORY second
--3 SETON BAY third
--7 CROM ABU fourth
--1 PUFFDIDI fifth
