Under Rule 876 (1) after the running of race 4, the Sander Ties Maiden at Otaki, a protest was lodged by jockey J Waddell, the rider of the provisionally 2nd placed horse OLD JOCK against the provisional winner MIDDLETONS BAY ridden by S Doyle.



Under Rule 876 (1) after the running of race 4, the Sander Ties Maiden at Otaki, a protest was lodged by jockey J Waddell, the rider of the provisionally 2nd placed horse OLD JOCK against the provisional winner MIDDLETONS BAY ridden by S Doyle.

Mr A Sharrock, in the absence of trainer J Wheeler, represented the connections of MIDDLETONS BAY.

Jockey J Waddell informed the committee that having spoken to Mr J Sargent, the trainer of OLD JOCK, he was representing its connections.

--

The margin between 1st and 2nd was a nose.

--

Mr J Waddell using the available films (no rear view was presented) told the committee he sat outside MIDDLETONS BAY down the straight and was keeping his line when MIDDLETONS BAY moved outward and bumped his mount. After the bump Mr Doyle’s mount continued to move outwards causing his mount to go off stride and he was carried approximately 2 horse widths outwards. He believed both incidents cost him a chance of winning with the margin between 1st and 2nd being only a nose. He estimated the incident cost him about half a length.

Mr A Sharrock informed the committee that jockey Waddell’s mount moved off its line prior to the bump and therefore contributed to the incident. He believed the bump was only a brush and jockey Waddell did not stop riding.

Under the rules stipendiary steward R Neal was asked to comment. He informed the committee that Mr Doyle’s mount had moved out forcing Mr Waddell’s mount off its running line to which it was perfectly entitled.

DECISION AND REASON

--

If a placed horse or its rider causes interference within the meaning of this rule 876 to another placed horse, and the judicial committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

The committee is of the opinion that interference did occur.

MIDDLETONS BAY’S outward movements did take OLD JOCK’S line and both horses did bump. The outward movement after contact was made caused by the continuing outward movement of MIDDLETONS BAY clearly affected OLD JOCK’S winning chances at a vital stage in the race. The margin of a nose between the two horses was in the committee’s opinion critical in the decision to uphold the protest. The side on film showed conclusively that OLD JOCK was taking ground off MIDDLETONS Bay in the final run to the winning post.
