Decision:

Following the running of race 4, the Famis F&M 1600, a protest was lodged by K Smith the rider of the 4th placed runner SORGENTE against the winner of the race MISS PICKLES.



Following the running of race 4, the Famis F&M 1600, a protest was lodged by K Smith the rider of the 4th placed runner SORGENTE against the winner of the race MISS PICKLES.

Mr Smith alleged that MISS PICKLES interfered with the chances of SORGENTE in the home straight.

--

Present at the hearing were jockeys Smith, K Myers, and C Lammas and trainers C Turner (SORGENTE) and P Belsham (MISS PICKLES)

When presenting his case Mr Smith referred to the films of the race, and using these demonstrated where, in his view, he felt that his chances of SORGENTE finishing in a higher placing had been effected by the actions of MISS PICKLES and/or its rider Mr Lammas.

The thrust of his submissions were that approx 150 metres from the finish he was contending for third place when MISS PICKLES moved out in front of him and took his line of running, forcing him to check and loose momentum. The significance of this being, in his view, that he was denied third placing.

Mr Lammas, when addressing the committee acknowledged that there had been some outward movement from his mount, however he submitted that the incident complained of was contributed to by an inward movement of SORGENTE toward his horse. Mr Lammas also submitted that it was doubtful notwithstanding the ?interference? that SORGENTE would have finished third due to the momentum of the eventual third placed runner MIDNIGHT GEM.

Mr Goodwin when addressing the committee stated that he believed there was movement from both runners. He also raised doubts notwithstanding the interference, that SORGENTE would have finished in a higher placing.

DECISION AND REASON

--

The committee when considering this protest firstly have to decide wether SORGENTE has suffered interference, and if we are satisfied that it has, we must then determine wether or not its chances of it finishing in a higher placing have been effected. If so satisfied we have a discretion that we can exercise with regards amending the placing's.

From viewing the films of the race it is obvious that Mr Smith has had to check SORGENTE some 150m metres out from the finish. We find that at this point there has been an outward movement by MISS PICKLES however there has also been a simultaneous inward movement from SORGENTE, which has contributed to Mr Smith having to restrain his mount. Nevertheless we find that the movement of MISS PICKLES was of significance and we are satisfied that SORGENTE has suffered interference, and that this has been primarily caused by the outward movement of MISS PICKLES.

When considering wether the chances of SORGENTE finishing in a higher placing have been effected we are particularly influenced by two factors. These being the degree of interference suffered, and the momentum of the other placed runners.

With regard to the interference we find that although Mr Smith has had to check his mount, the interference complained about was not of considerable significance. Secondly and of more importance to us is that SORGENTE has been leading into the straight has been headed, firstly by MISS PICKLES, and secondly MYTHICAL DANCER, which lends us to the view that the horse? s reserves had been somewhat dissipated and it was in essence, battling to the finish.

Considering these factors, together with the momentum at which the eventual third placed MIDNIGHT GEM was finishing, leaves us with serious doubt as to wether SORGENTE would have maintained third placing regardless of the interference.

We therefore are not going to exercise our discretion and we are dismissing the protest.
