As Mr Lammas admitted the breach the charge was found proved.
Penalty:
Mr Lammas is suspended for 5 riding days from the close of racing on Saturday 10 November 2012 to the close of racing on Friday 16 November 2012 – the 5 days being Avondale (12 November), Rangitikei (13 November), Riccarton (14 November), Otaki (15 November) and Dargaville (16 December).
Charge:
Following the running of race 5, information A1358 was filed by Stipendiary Steward Mr G Whiterod under rule 638(1)(d). The information stated "that approaching the 200 metres C Lammas angled out to obtain clear running when not clear of OUR DELIGHT which was checked". Mr Lammas signed the information admitting the breach and at the beginning of the hearing confirmed that was correct and also that he understood the rule under which he was charged.
Rule 638 (1) (d) states "A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless".
Facts:
Mr Whiterod asked Mr Neal to identify the two horses involved in the incident. He identified Mr Lammas on "Pimms Time" travelling approximately 1 horse width out from the running rail behind the leader "La Vie Onze" ridden by R Hannam. Mr Riddell on "Our Delight" was on the outside of and marginally in front of Mr Lammas. Mr Neal said that approaching the 200m mark Mr Lammas was travelling as well as any runner in the field and looking to find a way out from behind Mr Hannam. He said Mr Lammas moved out abruptly taking Mr Riddell off his rightful line of running and, whilst "Pimms Time" has slightly overreacted when being moved out, had Mr Lammas not moved out Mr Riddell would not have been forced off his rightful line. Mr Neal said riders were permitted to push out with care but on this occasion Mr Riddell had been severely checked. Mr Neal used the head on, side and rear view views of the film in support of his submissions.
Mr Lammas agreed that having got immediately behind the leader he had moved out. He said in doing so his horse had over reacted and he had come out further than he intended to. To a question from the Committee has said that he did not contemplate moving up on the inside of the leader as his horse had not wanted to move into that gap and in any event he thought that from the angle of the head of Mr Hannam’s mount that he was going to move closer to the rail.
Submissions for Penalty:
Mr Whiterod said this was Mr Lammas’ third careless riding charge in the last 12 months. He said he had been suspended for 5 riding days on 24 November 2011 and for 4 riding days on 24 October 2012. He submitted a suspension of 4 riding days was an appropriate penalty.
Mr Lammas said he had confirmed rides up to and including Saturday 10 November and asked for any suspension to commence after that date. He also said he had been booked to ride at Riccarton on Wednesday 14 November and asked for that day to be included in calculating any period of suspension. Mr Whiterod indicated the Stipendiary Stewards did not have any issues with the 14 November race day being included in any period of suspension should one be imposed.
Reasons for Penalty:
The Committee has reviewed the films of the incident taking into account the submissions of both parties. The Committee believes it was a deliberate action on the part of Mr Lammas to angle his horse out and make room for himself. In doing so he made firm contact with and pushed Mr Riddell off his rightful line of running. Whilst he then tried to straighten his mount the damage had already been done to Mr Riddell. Mr Lammas then went on to win the race with Mr Riddell finishing second 3.75l behind. We believe the severity of the incident is in the mid to high range. The interference caused to Mr Riddell must be reflected in an appropriate penalty which we have decided is a period of suspension. Mr Lammas’ request for a deferral of the suspension is agreed to in terms of Rule 1106(2).
From a starting point of 5 days we have added on 1 day because the deliberate action by Mr Lammas to create room for himself resulted in a severe buffeting to Mr Riddell and the loss of his rightful line of running. In mitigation we have taken into account Mr Lammas’ good riding record over the past 12 months and his admittance of the breach and are prepared to reduce the suspension from 6 days to 5.
