As the breach of the Rule was admitted the charge is found proved.
Penalty:
Mr Satherley is fined $250.
Charge:
Alleged breach of Rule 638(3)(b) following the running of Race 7 at the Otaki Maori RC meeting held on 6 November 2012.
The Information read: “W G Satherley used his whip in an excessive manner on a horse (He Kin Be Famous) out of contention”.
Facts:
All films were shown and they showed Mr Satherley striking his horse no less than 25 times in succession from outside the 200m up and until just short of the winning post (approximately 50m). During this time the horse was well back in the field and did not respond to the whip use.
Stipendiary Steward Mr Williamson said that the Stipendiary Stewards accepted the first 10 strikes of the whip, but not the remaining 15, as it was excessive and clearly unnecessary as his mount did not respond.
Mr Satherley for his part said that he did hit the horse several times but did not “hammer” it to the line. He said he stopped with about 75m to run. He agreed that his mount did not respond from the 200m.
Submissions for Penalty:
Mr Whiterod said that Mr Satherley has been back riding for a number of weeks after being away for several years and had not been charged for any offence. He said that in recent times an apprentice jockey had been fined $150.00 for a similar breach.
In answer to questions from the committee Mr Satherley said that he had been back riding for 6 weeks and had had 20 race rides and that he did know the whip use guidelines. He had nothing to add regarding penalty.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account the admittance of the breach, but the aggravating factor is that Mr Satherley (whilst being aware of the whip use guidelines) continued to use the drawn whip on a horse that was well out of contention and did not respond at any stage. We have considered the breach on this occasion to be above mid-range and have taken into account previous penalties imposed for similar breaches of the rule and the starting point of $300. Taking all matters into consideration the committee believed that an appropriate penalty for this offence is a fine of $250.
