Decision:

The charge of careless riding preferred against Mr Tinsley under the provisions of Rule 638(1) (d) was dismissed.

Facts:

Following the running of Race 7, Greenmantle Estate Lodge Handicap 1200m, an information was lodged with the judicial committee alleging that Mr Tinsley allowed his mount (ROHAISE) to shift inwards near the 700m dictating Edensong inward onto CATWOMANDU which in turn went inward onto PATIENCE which was checked.

Rule 638(d reads:

“A rider shall not ride a horse in a manner which the judicial committee considers to be careless”

The rule was read and Mr Tinsley acknowledged that he understood the charge and the rule and confirmed that he did not admit the breach.

Submissions for Decision:

Mr Hannam, the rider of EDENSONG, said that approaching the 700m he had Mr Tinsley on his outside and about one length clear, he said that Mr Tinsley shifted in a little, but that when he called he (Mr Tinsley) immediately went out. He added that at the time he was attempting to steady his mount but it over-raced and would not come back under him. He said that his mount continued to over-race for some time and said that he was not affected at all by Mr Tinsley’s mount. He added that at the time he was not aware that he had two horses on his inside.

Ms Myers, the rider of CATWOMANDU, said that she got tightened when inside Mr Hannam’s mount but did not know if Mr Tinsley’s mount had pressured the mount of R Hannam. She said that Mr Hannam’s mount was racing very keenly.

Mr Tinsley asked Mr K Smith, the rider of Eternity, who was racing behind Mr Tinsley’s mount at the time of the interference how far out from the rail was he racing? Mr Smith replied that he was four-wide and right behind Mr Tinsley. Mr Whiterod did not question Mr Smith.

All available films of the incident were then shown and Mr Goodwin said that Mr Tinsley shifted in onto Mr Hannam’s mount who in turn tightened Ms Myers' mount resulting in PATIENCE being checked.

Mr Tinsley for his part said that he was always four-wide and that that had been confirmed by Mr Smith. He said that the problem was caused by Mr Hannam’s mount over-racing and that PATIENCE contributed by racing on the wrong leg and shifting away from the fence (running rail). He added that his mount may have shifted a little but that that was not the cause of the interference.

In summation Mr Whiterod said that he did not agree that Mr Smith and Mr Tinsley were racing four-wide, he said he believed that Mr Smith was a little wider than Mr Tinsley and his mount. He added that Mr Tinsley shifted in on Mr Hannam’s mount when not clear and that this resulted in the check to PATIENCE.

Reasons for Decision:

After careful consideration of all the evidence, the committee revisited all films and perused same at length. What was very clear was that PATIENCE was checked and lost its position. However due to the lack of a direct head-on and/or rear film or observation, as the interference occurred on a bend, it could not be established by the committee whether Mr Tinsley and his mount was the cause of the interference to PATIENCE, or whether it resulted from Mr Hannam’s mount’s racing manners.

As a result the charge was not proved.
