Facts:
Following Race 2 (Otaki Mail Maiden) a protest was lodged pursuant to Rule 642(1) by Mr D Turner and Mr J Parkes alleging that horse number 4 (ONE OF THE BEST) or its rider placed 1st by the Judge interfered with the chances of horses 1 (MASTER COURTSMAN) and 3 (CAGE PHYTA) placed 2nd and 3rd by the Judge.

Before hearing from the affected riders, all the available views of the final stages of the race were played. Mr Goodwin identified the three horses involved in the protest.
Mr Parkes protested on the grounds that he received pressure from the horse on his outside ridden by Ms Andrew. He said he managed to get a break on the bend, but on straightening up, ONE OF THE BEST began to lug in on him. This forced him from a 5-wide position to a 2-wide position at the finish. In addition, he had to stop riding just short of the line. Mr Auret used the rear-view video to show where contact was made between Ms Andrew's mount and CAGE PHYTA soon after the home turn. The further the race went on, the tighter it became, and Mr Auret said his horse's chances had been extinguished.
Mr Turner, who ran second, said the contact he received happened "late in the piece". He used the head-on film and said his horse had been almost turned sideways by the pressure he received from the outside. For 2 strides just short of the post he was forced to stop riding and as a result, lost momentum. Mr Wheeler said he didn't have much to add, but Mr Turner's mount had not been impaired too much because the interference was only in the last couple of strides.
Ms Andrew (ONE OF THE BEST) used the videos to show where Mr Parkes came out on the bend and shunted her out of the way to gain clear racing room. This placed him in front of her rounding the turn. She admitted to then contacting CAGE PHYTA when her horse began to hang inwards but said she stopped riding and straightened her line. Ms Andrew maintained Mr Parkes had plenty of time in the straight to beat her, but couldn't and she won by a long neck.
For the Stewards Mr Goodwin said Mr Parkes made his own run on the turn and was ¾ length in front of the winner at the top of the straight. He conceded that ONE OF THE BEST lay in most of the way down the home straight, but said it always had the measure of the other two horses.
Reasons for Decision:
Rule 642(1) states:
If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first-mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
The Committee considered all the submissions and reviewed the films. ONE OF THE BEST was a challenging ride for Ms Andrew lugging in continuously down the home straight. In considering the protest from the third-placed horse CAGE PHYTA, it was significant that the winner came from behind this horse and won by the combined margins of a long neck and a short neck. ONE OF THE BEST clearly caused interference to Mr Parkes' mount; however, the Committee was not satisfied that this prevented CAGE PHYTA from winning the race. Ms Andrew stopped riding on two occasions to straighten and still won comfortably. The protest 3rd against 1st was dismissed.
MASTER COURTSMAN finished second by a long neck. Just short of the line it was tightened slightly, but the Committee was not convinced that it would have beaten ONE OF THE BEST had the incident not occurred. It was very close to the line, and the winner was finishing on strongly. The protest 2nd v 1st was also dismissed.
