The protest is upheld and the Judge's placings now read:

Facts:

Following Race 4 Mr Goodwin lodged a protest under Rule 642(1) alleging thst Vronski or its rider placed 4th by the judge interfered with the chances of Jungle Fever placed 5th by the judge. The interference occured in the home straight.

The Judge's placings were:

1st      No 7    Royal Rose

2nd     No 14  Miss Lincoln

3rd     No 2    Darceeduncan

4th      No 1     Vronski

5th      No 8     Jungle Fever

6th      No 6     Ngario

The relevant margin (between 4th and 5th placed horses) was a nose.

Submissions for Decision:

Mr Goodwin showed side-on, head-on and rear-view videos of the final stages of the race from the point of the turn until the end of the race.

M Tanaka, riding Jungle Fever, angled his mount inwards towards the running rail prior to the 200m mark when he saw a gap open up to the inside of Vronski ridden by Mr Tinsley. As he moved into the gap Mr Tinsley's mount  moved back inwards forcing Mr Tanaka to take a hold of his horse, change ground and seek a run to the outside of Vronski. The side-on view then showed Jungle Fever finish the race off strongly for 5th getting to within a nose of Vronski who finished in 4th place.

Mr Tanaka said that he was well into the gap between Vronski and the running rail when that gap closed forcing him to check back and go for a run to the outside of Mr Tinsley.

Mr Tinsley said that during the race he thought he was up against the running rail and did not realise that he had rolled off the fence enough to allow another horse through. He was not aware of Mr Tanaka moving up on his inside.

Mr D Wilson the trainer of Jungle Fever and Mr Lynds, the trainer of Vronski arrived late into the judicial room after attending to their horses.

The films were replayed for their benefit with Mr Wilson agreeing that his horse had been forced to change ground and had finished strongly and Mr Lynds commenting that it was a "line call".

Reasons for Decision:

The committee took into account all of the evidence and submissions as presented. The films were clear in showing that Jungle Fever had to be eased back after coming up along the inside of Vronski. The head-on view confirmed that Vronski had rolled inwards and closed the gap on Jungle Fever which gave Mr Tanaka no option but to stop riding, rebalance and change to a run on the outside of Mr Tinsley. The committee was satisfied, after looking at the head-on and rear views, that there was a sufficient gap for Mr Tanaka to take and the side-on view showed that he was well up into this gap when it closed on him.

Jungle Fever, once rebalanced and with a clear run to the line, made up ground quickly and was gaining on Vronski at the finish.

Taking into account the stage of the race that the interference occurred, the manner in which Jungle Fever finished the race and the narrow margin of a nose we were satisfied that had the interference not occurred Jungle Fever would have beaten Vronski.
