The protest 2nd against 1st was upheld.

Authorisation was given for the payment of dividends and prize money on the amended placings.

Facts:

Following the running of race 3 (HUNTING & FISHING OTAKI 3YO MAIDEN), an Information instigating a protest was filed with the Judicial Committee. It was alleged that the first placed horse OSCAR’S SHADOW had interfered with the chances of the second placed horse O’CEIRINS CHOICE over the final stages.

The judge’s placings were as follows:

1st  7 Oscar’s Shadow
2nd 8 O’Ceirins Choice
3rd 4 Epic
4th 9 All In Glamour
5th 1 Belle Boy

The official margin between 1st and 2nd was a short head.

Rule 642(1) provides as follows:

If a placed horse or its rider causes interference within the meaning of this Rule 642, to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.

Submissions for Decision:

Mrs Cookson said that 50m off the winning post her horse was coming outside Rosie’s mount (OSCAR’S SHADOW), Rosie then came out and knocked her horse’s (O’CEIRINS CHOICE) hindquarters. She added that her horse was still coming on and said that in her opinion her chances of winning were affected as her horse lost momentum due to the interference.

Mr Mo, the rider of O’CEIRINS CHOICE said that his horse was coming home strongly and that the inside horse came out and his horse got hit. In answer to a question from the committee Mr Mo said that he would have won the race had he not been interfered with.

Mr Lowry, the co-trainer of OSCAR’S SHADOW said that both horses moved off-line and that tiny contact was made at that point. He said that the severe interference, if you called it that, happened right on the line and that the interference made no difference to the result.

Miss Myers the rider of OSCAR’S SHADOW said that Mr Mo had the entire straight to get past her and that both horses were racing greenly. She said there was no denying her horse had shifted out over the final 50m and that she had stopped riding just as much as Dylan (Mo) did. She added that it was just as much a hindrance to her horse as it was to Dylan’s and said that her horse shied away from the winning post the last 10-20m.

Mr Neal was asked by the committee to synchronise the head and side-on films and give an indication of how far from the winning post it was when Oscar’s Shadow first came out into the line of O’CEIRINS CHOICE. Mr Neal said that the distance was 30m. Mr Neal was then invited to comment on the alleged interference but not on the merits of the protest. He said that OSCAR’S SHADOW had been under hard riding and shifted outwards abruptly short of the winning post and that Mr Mo’s mount (O’CEIRINS CHOICE) was affected as a result.

Reasons for Decision:

After considering all of the submissions and the film evidence the committee found that with approximately 5 strides to travel OSCAR’S SHADOW commenced to shift out into the line of O’CEIRIN’S CHOICE and with 3 strides to travel OSCAR’S SHADOW shifted out abruptly and made very firm contact with O’CEIRINS CHOICE. Prior to the interference occurring O’CEIRINS CHOICE was finishing strongly and taking ground off OSCAR’S SHADOW. Taking into account the short-head margin, the way both horses were finishing, where the interference occurred and the relatively severe bump to O’CEIRINS CHOICE which as a result lost momentum, the committee was satisfied that if interference had not occurred that O’CEIRINS CHOICE would have beaten OSCAR’S SHADOW.
