Facts:
Mr Neal alleged that in Race 3 (Hunting & Fishing Otaki 3YO Maiden), Mr Mo allowed his mount O’CEIRINS CHOICE to shift inwards in the back straight when not clear of O’REILLY’S DANCER (D Bradley) which as a result was checked.
Rule 638(1)(d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Mo acknowledged that he understood the charge, the rule and confirmed that he admitted the breach.
Mr Neal showed all films and said that in the run down the back straight Mr Mo was racing one-off the fence, he then shifted in a little which compelled Mr Bradley to check out of his running. He added that Mr Mo was about half to three quarters of a length clear when he shifted.
Mr Mo and Mrs Zimmerman did not have anything to say.

Mr Neal said that Mr Mo had a very good record, having only incurred one suspension for careless riding, that being in May 2015. He said that in recent times Mr Mo had upped his game and was now a promising apprentice who is doing well. He said that he believed that a term of suspension should be imposed.
Mrs Zimmerman said that the carelessness was minor and that Mr Mo did relieve the pressure when he realised what had happened. She added as Mr Mo did not have any firm upcoming riding engagements they wanted any suspension imposed to commence immediately.
Reasons for Penalty:
The committee was mindful of the 5 days suspension starting point for careless riding. In this instance of careless riding the committee did not believe that there were any aggravating matters to be considered. The mitigating factors were Mr Mo’s very good record, admission of the breach, low-end carelessness as the shift was minor and that Mr Mo did take corrective action. In fixing penalty we also took into account the sparsity of Central Districts racedays in the coming weeks.
