Decision:

Following the running of race 1, the Creative Catering Maiden, Mr Riddell was charged with careless riding under rule 638 (1) (d).  The information alleged that “J Riddell, the rider of FOREMOST, allowed his mount to shift in when not clear of TEASJAH (O Bosson) and GROSVE QUAY (B Lammas) causing tightening to those runners near the 2000 metres”.

Following the running of race 1, the Creative Catering Maiden, Mr Riddell was charged with careless riding under rule 638 (1) (d).  The information alleged that “J Riddell, the rider of FOREMOST, allowed his mount to shift in when not clear of TEASJAH (O Bosson) and GROSVE QUAY (B Lammas) causing tightening to those runners near the 2000 metres”.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”

Mr Riddell indicated on the information he admitted this breach of the rules.  He also agreed he understood the charge and the rule it was laid under.  As the breach of the rule was admitted the charge was proven.

Mr Neal asked Assistant Stipendiary Steward Mr Barnsley to show the head on and side on videos of the incident.  Mr Barnsley said Mr Riddell was drawn 1 from the outside and shortly after the start he commenced shifting inwards looking for a run closer to the rail and in doing so came across in front of Mr Bosson when not the required distance clear causing Mr Bosson to take a hold of his mount.  In doing so Mr Bosson moved in on Mr Lammas who was also tightened.

Mr Riddell said that he began awkwardly and was under instructions to go forward.  As he was moving across he saw Mr Bosson take hold and thought he was clear but admitted the videos showed that wasn’t the case and he had been careless.  He also said he thought Mr Bosson was only inconvenienced for a stride.

Penalty Submission

In relation to penalty Mr Neal said Mr Riddell was last charged under this rule on 30 May 2009 at Wanganui and had received a 4 day suspension. He described the incident today as an error of judgment as when Mr Riddell moved across the line of Mr Bosson’s mount he was not his own length and another length clear which resulted in a check to Mr Bosson and some inconveniencing to Mr Lammas.  Mr Neal described the incident as being at the lower end of the scale, the horses were settling into a racing order and as Mr Riddell has come across Mr Bosson he had left him short of room.  He further said the incident happened with approximately 2000m to run and the two affected horses had their chance to recover from it.  Nevertheless it was careless riding on the part of Mr Riddell and he thought a suspension “at the bottom end” was an appropriate penalty.

Mr Riddell asked for his riding manager, Mr Brent Wall, to come into the room to confirm to the Committee what upcoming engagements he had. He confirmed that if Mr Riddell was to be suspended it should commence after the close of racing on Saturday 31 October 2009.

Decision

--

In coming to a decision on penalty the Committee considered the incident as shown on the video and all the submissions put before it.  We have taken into account Mr Riddell’s admittance of the breach, his good riding record and we agree with the Stipendiary Steward’s view that the offending is at the lower end of the scale.  We have noted there was some settling in as the race commenced and that the interference was minimal, however, the safety of the other riders was compromised as both Mr Bosson and Mr Lammas had to restrain their mounts to avoid clipping the heels of Mr Riddell’s mount.  Had they not done so a fall could have easily resulted.

Mr Riddell is suspended from the conclusion of racing on Saturday 31 October 2009 until the conclusion of racing on Saturday 7 November 2009, that being 4 riding days.
