An information was lodged by Stipendiary Steward Mr. N. Goodwin against rider Mr. B. Lammas alleging a breach of Rule 330 (3) (c) in that B. Lammas failed to make the weight for STARRING in Race 2.

Mr. Lammas admitted the breach but wanted to explain to the committee the reasons why he presented 1 kilogram overweight.  He said that it is not uncommon for him to lose a kilo on the morning of the races which he does by spending time in the spa and sauna.  Today, however, he felt unwell when he was in the sauna and vomited a number of times. He had to drink extra water to rehydrate which prevented him getting down to the required weight.

Mr. Goodwin said that while Mr. Lammas should have notified the Stewards earlier adequate replacement riders had been found. (Mr. Lammas was also replaced on FROM THE SPOT in Race 4).  He said that Mr. Lammas was fined $350 for the same breach in November last year and had a couple of other breaches prior to that one.  His submissions were for a fine in the vicinity of $150 - $250.

Penalty

In coming to a decision on penalty the committee took several factors into consideration. It was ascertained that Mr. Lammas had in fact had 4 charges of being overweight in the last 12 months. This is not a good record but Mr. Lammas assured the committee that he had stopped accepting rides around 52 ½ kilos and would only accept light-weight rides in the future under exceptional circumstances.

We accepted that had Mr. Lammas not been unwell today he would probably have been able to make the correct weight and we also gave him some credit for it being four months since his last breach.  Mr. Lammas was reminded of his responsibilities, one of these being early notification to the Stewards of any weight issues.

He was fined the sum of $300.00
