The protest was therefore dismissed and placings allowed to stand as called by the Judge.

Facts:

Following the running of race 9, the Haunui Farm Group One WFA Classic, Mrs L Allpress lodged a protest alleging that WALL STREET or its rider placed 2nd by the judge interfered with the chances of DASOUDI placed 3rd by the judge. The interference occurred in the home straight.
Judge's placings were:
1st    KEEP THE PEACE
2nd   WALL STREET
3rd    DASOUDI
4th    HOLD IT HARVEY
5th    BARINKA
6th    SPIRO
The relevant margins were a long neck and one and one quarter lengths.

Submissions for Decision:

Mrs Allpress used the head-on, side-on and rear view films to show the committee that on rounding the bend for home she was in the trail tracking WALL STREET (M Coleman)  waiting for a run. That run came on the turn when Mr Coleman rolled off the fence enough to present her with a gap to his inside. As she went for the gap, however, Mr Coleman rolled back inwards closing it. She was forced to take a hold of DASOUDI, angle outwards and make her run three horse-widths further out. She said as a result of the interference she lost at least two and a half lengths and ran on well for third. In her opinion, had she had the run she was entitled to on the rail, she would have run second and may well have won the race.
Mr Miller said that the films clearly showed DASOUDI had nowhere to go and the fact that Mrs Allpress had to go wider looking for a clear run definitely cost her the chance of running second.
Mr Coleman admitted that WALL STREET rolled inwards prior to the 200 metre mark but said before this point (for about 150 metres) there had been sufficient room for Mrs Allpress to improve inside him. DASOUDI did not improve quickly enough and in his opinion was battling to stay in that position. He concluded by saying that DASOUDI was not really making up any ground at the finish.
Mr Lynds agreed saying that DASOUDI was clearly not travelling well enough compared to WALL STREET and KEEP THE PEACE who were accelerating away from the field and fighting out the race in front. While there had been interference to DASOUDI it was not to the degree of 1 1/4 lengths.
For the Stewards Mr Goodwin said that WALL STREET had shifted in off its line and taken the run that DASODI was entitled to on the inside. He ascertained, from Mrs Allpress, that she was established in the gap at the time that Mr Coleman rolled inwards. She had to ease her mount for several strides and angle outwards around WALL STREET and KEEP THE PEACE. She did make some ground on those two horses at the finish but it was a difficult decision because of the margin. Following a request from one of the committee members an additional camera view from the back straight was played which gave a fourth view of the incident.

Reasons for Decision:

The committee took into account all of the evidence and submissions as presented. The films, particularly the head-on view, clearly showed the incident as described by all parties. Mrs Allpress on DASOUDI had her line taken when WALL STREET rolled  inwards down the home straight forcing her to seek a clear run out wider. The rear-view showed this to be a gradual movement resulting in DASOUDI being hampered rather than suffering a severe check. We were satisfied that Mrs Allpress was established in the gap when WALL STREET moved inwards and the fact that she had to ease back and race wider has obviously caused her to cover extra ground.
Rule 642(1) says that the Judicial Committee must be of the opinion that DASOUDI would have finished ahead of WALL STREET had such interference not occured. Taking into account the way in which the first two horses were accelerating away and the margin between WALL STREET and DASOUDI of 1 1/4 lengths we were not convinced that, despite making up some ground, DASOUDI would have beaten WALL STREET.
