Miss Goldsbury you are fined $300.

Facts:

Following the running of Race 4 at Otaki (The NZB Insurance Pearl Series) Miss Goldsbury admitted a charge brought under Rule 638 ( b) (11) in that she used her whip in an excessive manner prior to the 200 metre mark.

Miss Goldsbury confirmed she understood the rule. The films of the incident were shown and stipendiary steward N Goodwin informed the committee that Miss Goldsbury's mount VERACIOUS was racing at the back of the field. She used the whip until about the 200 metre mark. The stewards estimated the mount was struck 16 times in the run to the 200 metre mark....well outside the guidelines. Very little respite was shown by the jockey until the 200 metre mark.

Mr Williamson told the committee that although the strikes exceeded the guidelines the horse was not struck with unnecessary force. Miss Goldsbury informed the committee that she thought she was okay but did agree that she exceeded the guidelines.

Mr K Smith assisting Miss Goldsbury concurred the guidelines were exceeded but the change in track conditions to a heavy 11 may have tripped Miss Goldsbury up.

Submissions for Penalty:

Mr Williamson believed the charge could best be handled by a fine and indicated the stewards would be happy with an amount less than the recommended starting point of $500.

Miss Goldsbury had no comment but did say this was her first charge under this rule in 12 months.

Reasons for Penalty:

The committee in coming to its decision to impose a monetary penalty took into account her admittance of the breach and the fact this was her first charge under the rule.

We were mindful of the JCA guidelines but believed there should be a reduction in this particular case.
