Decision: Following the running of Race 11 at the Otaki Maori race meeting, a protest was lodged by Stipendiary Steward Goodwin alleging that ‘Nikai’, provisionally place 2nd by the judge, interfered with ‘Littlebithot’ provisionally place 4th equal by the judge
Following the running of Race 11 at the Otaki Maori race meeting, a protest was lodged by Stipendiary Steward Goodwin alleging that ‘Nikai’, provisionally place 2nd by the judge, interfered with ‘Littlebithot’ provisionally place 4th equal by the judge. The margins were ½ length - NK - 1 ½ lengths - dead heat.

Present at the enquiry were: Nikai’s trainer Mr. J. Boon, Nikai’s jockey Mrs. L. Allpress. Littlebithot’s trainer Mr. Fleming, Littlebithot’s jockey Mr. D. Stackhouse.

All connections were aware the protest was lodged. Mr. N. Goodwin, in using the available films, indicated to the committee the point of the race the incident occurred. He called as a witness Jockey D. Stackhouse who informed the committee that the outward movement of Nikai caused his mount to lose momentum, he had to stop racing momentarily. Contact was made with Nikai. He told the committee he called out and felt the incident cost him a chance of finishing in second place.

Stipendiary Steward Goodwin informed the committee that the outward movement of Nikai over the closing stages of the race caused contact with Littlebithot and Jockey Stackhouse had to stop riding and change ground. Three films - head, side and back on were used to illustrate the incident. Mr. Fleming told the committee his horse did lose momentum and felt the incident cost his horse a chance of running second.

Mr. J. Boon felt that his horse was traveling the better and while contact was made he felt that Littlebithot had come to the end of its run. Mrs. Allpress concurred that contact was made very briefly, she felt that Littlebithot was moving outwards as well and did contribute to the incident. She didn’t see the horse on her outside but did confirm she heard Jockey Stackhouse call. She felt that Mr. Stackhouse had to stop riding for only one stride. She felt her horse was traveling the better.

Stipendiary Steward Goodwin, in summing up, told the committee that his concern in the protest was that the interference that did occur cost the horse Littlebithot a chance of finishing fourth on its own. He believed that the horses chances of finishing in the first there were not effected by the incident.

Rule 876 (1) requires us to ask first whether the interference occurred and then if so whether that interference has cost the horse interfered with a chance of finishing in a better placing.

The video evidence and the statements from all parties agreed that interference did occur and contact between Nikai and Littlebithot did happen. We are mindful of the margins - 1 length - Nk - 1 ½ lengths and dead heat and also of the comments of Stipendiary Steward Goodwin that the interference, he believed, could have affected the chances of finishing fourth on its own, not of finishing in the first three.

We have viewed the available films again and note that the dead heated provisionally placed horses were wide apart on a heavy track. We are of the opinion that serious doubt exists whether or not the chances of Littlebithot of finishing in fourth place on its own. As doubt exists, we have used our discretion and allowed placings to stand.

The protest is dismissed.
