Facts:
Prior to the running of Race 8 (Aquashield Roofing Handicap) Information No. A12315 was filed with the Judicial Committee. It was alleged that Ms Gordon failed to declare a Rider for BELLA NERO until after 8am on Raceday.
Ms Gordon said that she understood the Rule and confirmed to the Committee that she understood the breach.
Mr Goodwin said that Ms Gordon had not declared a Rider by the specified time and that the Racing Bureau had attempted to contact her but had been unable to do so. He said that the Bureau then left a message for Ms Gordon to telephone them but they did not get any response. He said that Ms Gordon contacted the Bureau on race morning to declare a Rider (DG Bradley). Mr Goodwin said that both D Bradley and C O’Beirne were available at declaration time.
Ms Gordon agreed with Mr Goodwin’s submission.

Mr Goodwin said that the Racing Bureau was disappointed that a rider could not be declared. He said Ms Gordon’s record shows that she has been a habitual offender under the Declaration Rule. He said that in the past Ms Gordon has received fines of $50 to $100 for breaches of the Rule and recommended an increase in penalty. Ms Gordon’s record showed that she had breached the Rule 7 times since 2013. Ms Gordon said that she should have telephoned the Bureau but that she did struggle to get a Rider and was actually going to scratch the horse until the rain came.
Reasons for Penalty:
The previous penalties imposed have clearly not had the desired effect with Ms Gordon continuing to breach the Rule. Punters have a fundamental right to know riding engagements when making their selections.
The Committee determined that a significant increase in the past penalties imposed was appropriate.
