Following the running of Race 7 Mr. P. Bell was charged with failing to weigh in under Rule 858(1) (a).
Following the running of Race 7 Mr. P. Bell was charged with failing to weigh in under Rule 858(1) (a). The information alleged that apprentice jockey Patrick Bell the rider of El Sporty failed to weigh in resulting in his mount being disqualified.

Mr. Bell admitted the breach and was assisted at the hearing by Mr. G. Searle.

Mr. McCutcheon told the committee that in past incidents of riders failing to weigh in (in dividend-bearing positions) a suspension has always been the penalty imposed. He said that despite this being Mr. Bell's first offence punters and owners had been seriously affected and that penalty must be by way of suspension.
--Mr. Bell told the committee that he was coming through the weigh-in room and he walked right past the scales. He said that it was a mistake and that he deserved to be penalised.
--Mr. Searle had nothing to say.
--Penalty
--In coming to a decision on penalty the committee took into account all of the submissions. It was the view of the committee that this was a serious breach of the rules. The connections of El Sporty have forfeited second place and suffered a financial loss while the betting public have been seriously affected by Mr. Bell's mistake.
--The committee agreed that a suspension was warranted and that the length of the suspension must reflect the seriousness of the breach.
--Mr. Bell is suspended from the close of racing on Saturday July 22nd until the close of racing on Thursday August 17th. Rule 523 (3) allows for the forfeiture of a riders riding fee which we now order.

Request for a Ruling
--Immediately following the running of race 7 Mr.L.N. McCutcheon requested a ruling under 856 (1) in which he sought that El Sporty be disqualified due to rider P. Bell failing to weigh in for 2nd place.
--Rule 856 (1) states:
--The riders of the first four horses or, where the conditions of the race provide a fourth prize, the riders of the first five horses or, where the conditions of the race provide a fifth prize, the riders of the first six horses and any another rider or riders the Stewards or Clerk of the Scales may require shall be weighed in and any such horse whose rider does not weigh in shall be disqualified from the race.
--Provided that the Stewards may exempt any such rider if satisfied that, on account of accident or sudden illness, it is impractical for him to weigh in and in such case his horse shall not be disqualified on the ground of the rider not weighing in if the record of the weighing out shows the rider to have weighed out with the proper weight.
--The circumstances did not provide for any exemption, Mr. Bell forgot to weigh in. El Sporty was disqualified and placings were amended accordingly.
