Mr D Bradley, rider of BALLY HEIGHTS, was charged under Rule 871 1 (d) in that he allowed his mount to shift in when not clear of GLADSTONE, ridden by L Callaway



Mr D Bradley, rider of BALLY HEIGHTS, was charged under Rule 871 1 (d) in that he allowed his mount to shift in when not clear of GLADSTONE, ridden by L Callaway resulting in that runner being checked.

Mr Goodwin called jockey L Callaway who informed the committee that BALLY HEIGHTS was improving around him when that horse moved inwards necessitating him to take hold of his mount. Mr Goodwin asked jockey Callaway how far in front Mr Bradley was. Callaway replied that he was just behind his hindquarters. He had to stand up and take hold.

Mr C George showed both the head and side on film and told the committee that Mr Bradley's mount moved inwards rounding the bend. Mr Bradley corrected at that point but once he drew the whip BALLY HEIGHTS rolled inwards again taking Mr Callaway's line to which he was entitled.

Jockey D Bradley had no questions regarding Stipendiary steward Georges interpretation of the films.

Mr D Bradley told the committee his mount travelled three wide rounding the bend. . He did lay in. He then corrected and stopped riding for a couple of strides. He then drew the whip and the horse rolled inwards. He believed that it was not careless riding?..he was a victim of circumstances.

Mr Goodwin, in summing up, informed the committee that Bradley kept riding after initially correcting and believed he took Mr Callaway's rightful line.

DECISION AND REASON

--

The committee viewed the available films. The head on film confirmed that Mr Callaway's mount was entitled to the line it was on. While jockey Bradley did pull off and straighten on rounding the bend for a couple of strides, his mount, upon being struck with the whip, moved inwards causing jockey Callaway to take hold and stand up in the saddle.

The committee found the charge proven.

SUBMISSIONS ON PENALTY

Mr Goodwin told the committee that although the charge was not at the top end he felt a period of suspension was appropriate.

Jockey D Bradley, in his submission, confirmed that he did ride in the South Island. He did intend to ride at the NZ Cup Carnival and that he very seldom, if ever, travelled mid week to ride in the Northern districts.

The committee carefully considered the submissions placed before it.

--

In reaching its decision to suspend D Bradley the committee took into account Stipendiary steward Goodwin's comment that it was not a charge at the top end of the scale. The committee also took into account that the period of suspension included the first day of the NZ Cup Carnival. (A premier day) The committee was also mindful of the fact that jockey D Bradley did not admit the breach of the rule.

Jockey D Bradley was suspended from race riding at the completion of racing on Saturday 4 November 2006 until the completion of racing on Sunday 12 November 2006.
