Facts:
Following the running of Race 4 (Creative Catering Maiden) an Information was lodged with the Judicial Committee alleging a breach of Rule 638(1)(d) in that Miss Chiong allowed her mount (OUTSPOKEN) to shift out in the home straight and check IRISH CHAT.
Rule 638(1)(d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Subsequent to the rule being read Miss Chiong and Mr Sharrock acknowledged that they understood the rule and the charge.
All relevant films were shown and Mr Goodwin said that Miss Chiong allowed her mount to shift out into the line of IRISH CHAT and that IRISH CHAT was checked. He added that Miss Chiong did not have sufficient control of her mount and did not do enough to keep it straight. He said that IRISH CHAT would have possibly finished in a higher placing had it not suffered interference.
Miss Chiong invited Mr Sharrock to speak on her behalf. Mr Sharrock told the committee that Mr Riddell, who was back and to the inside of Miss Chiong, called to her to give him more room and that Miss Chiong over-did it by shifting out too far and that her horse had overreacted. He added that this was not an excuse for her carelessness as they had admitted the breach but it was a mitigating factor. He added that Miss Chiong was a junior rider who to date had ridden 30 winners.
Submissions for Penalty:
Mr Goodwin said that the carelessness was on the low side and that Miss Chiong had a good record having only been suspended once during the past 12 months for careless riding, that being on 4 September 2014 when a suspension of 4 riding days was imposed. He submitted that a suspension was an appropriate penalty.
Mr Sharrock said that Miss Chiong is a Central Districts rider who does from time to time ride in the northern area. He said that there was an Apprentice Riders Day at New Plymouth on 30 October 2014 and that he was keen for her to ride at that meeting. He added that if a suspension was to be imposed that it start at the end of the days racing.
Reasons for Penalty:
The mitigating factors were that Miss Chiong admitted the breach and had a very good record. An aggravating factor was that the horse that was interfered with (IRISH CHAT) who finished 5th was coming into the race strongly at the time of the interference and would have possibly finished in a dividend bearing position. The committee, after using the starting point of 5 days suspension, believed that a 4 day riding suspension was an appropriate penalty.
